I purchased a lot of nine 5x5 mirrors on 9/7

When I received them on 9/16, there were only two mirrors, one of which was broken.

The seller claims on his profile that he accepts refunds and will work with bidders if they are unhappy. 

Um...suuuure he does  :sleepy:

I didn't pay much for this lot ($12.99 total), but I didn't get what I paid for.

I opened a case as soon as I saw what was in the box.  He refuses to take responsibility for the missing items (or the broken mirror).  Best quote of all our messages:

"alls i can say is that someone opened it up and took them. i would never just send two. i dont need them. i sold a gun case last year and the guy never got it. but it was sent with a delivery confirmation and ended up nowhere. someone that checks the boxes took them from the post office then."

Whaaaaat?  Why would someone do that?  I mean, the package was sealed!  Sure he used a cardboard box that was so damaged it was ridiculous, but it certainly wasn't opened :dizzy:

Anyway, he said on 9/17 that he would refund me on 9/20.  That was yesterday.  No refund.

Should I give this guy until Monday or just escalate the this to eBay now?

hmmm..Give till monday then escalate. It is the weekend after all.

I agree that I would wait till Monday but I would probably also send him a nice little reminder today or tomorrow that you are still waiting????


I sorta had to laugh at his comment of the PO taking them though, because he acts like it happens all the time to him  :lol:

I have been selling stuff for years, and.. I have never had someone from the post office open a box, take some of what was inside, and then send it on to the buyer. That guy has some imagination!

To me, that is just bad business. If something goes wrong with a shipment, or if I as the seller make an error, I refund or partially refund the customer. Once I mailed the wrong skirt to a customer, and rightfully, they complained. I gave them a partial refund and sent the correct skirt asap. I have had lost packages here and there, in those cases, I refund the person completely. It's not the customers fault that the item got lost. (Fraudulent situations aside.)

He should give you a FULL refund. You only got two out of nine mirrors and one was broken. That's ridiculous. He should also not be so hostile. He seems very unprofessional. If he genuinely had sent the correct amount of mirrors, his first response should have been apologetic to you and then he should have filed a postal claim or something. And then refunded you because you just flat out did not get what you paid for.

Yes, somebody only wants three of your five mirrors. They opened the box without cutting the tape or damaging the box.

Mirror wouldn't have broke if you knew how to package a 'glass' type item properly.

In other words, not owing up to his problem, which it is.

I didn't want to call the guy a liar.  I figured 8 mirrors for $12.99 means that each mirror cost approximately $1.62.  Seeing as that I only got two (this was before I noticed that one was broken >_<), a partial refund of $9.75 would be reasonable.  This is what I said:

"It's hard to say what happened. I thought that you may have forgot to put the rest of the mirrors in the package and didn't realize that they were still in your possession. What I do know is that seller's are responsible for items until they are in the buyer's possession. Did you, by any chance, add insurance for this package? If you did, we can go through the postal service to have this resolved. If no insurance was purchased, I would like a refund. Seeing as that I paid a total of $12.99 for eight mirrors and two of them arrived, may I request a partial refund of $9.75?"

He agreed to a refund and said he'd do it Friday.  Still waiting...

wow what a story :crazy:  still, you handled  it well :bigups:  I'm glad he agreed to a refund but if he doesnt send it when he said he would (Monday, right? so today) then I'd escalate the case..

Yeah thats what I would have done too, you've given him 3 extra days to make it right and he still hasn't. If he had been nice then it might have been one thing but his attitude about it proves he doesn't care (his back story about the gun case also proves that this is a common problem for him.)

...and less than three hours later, eBay gave me a full refund.
