I really don't want to sound too mean. But to be honest I think sometimes we need to remember that these toys are aimed at children and are on the cheap end of the price bracket. We are not spending $200 for a couple of ponies we are spending $20. So unfortunately the odd factory flaw, and I would say these are quite minor, is normal. If the seller had opened the item to check condition it would no longer have been MIB after all. I am sure ebay can force the seller to accept your return [although you will be responsible for your postage back to them] and you should be able to get your refund. But I personally dont think the seller has actually done anything wrong in this situation and if they accept the return of an open item which they shipped MIB then they are actually being quite a good seller. Perhaps when purchasing in the future if you expect perfection you could consider only purchasing open items which you can ask for complete images of from sellers?I hope you manage to get everything sorted out.
