There was a kerfuffle a number of years ago about this on Etsy. I think there are some jurisdictions in the U.S. where there are laws prohibiting the sale of old toys as "toys" -- however, I think a lot of people get around this by writing a disclaimer that the item they are selling is for collectors and not for use as a toy by children.

Of course, that wouldn't work in a thrift shop.

I, too, will join the Brigade of People Who Will Save the Children by Taking All the G1 Ponies ;)
