Didn't receive item but eBay won't let me file a claim??? **UPDATE**

A week and a half ago, I won an auction for a Nintendo DS game case.  I paid promptly for the item, it was $.99 plus $2 in shipping.  The seller printed the postage off and then...nada.  I haven't received it yet, and it's not registered as shipped.  I've sent a message to the seller asking her when the item will be shipped but I've not heard back.

So I went today to file an unreceived item claim, hoping to spur the seller to pop it in the post.  But eBay responded with this:

"We're sorry there's an issue with this purchase. Unfortunately, PayPal reports that we can't open a case for this item.You can try to work out this problem by contacting the seller."

Has anyone else had this happen???    I realize that it's only $3, but I would like my item.  And typically if the seller hasn't sent in an allotted time (7 days I think) you will be able to file a claim.

Help please. 


**UPDATE**

Just checked the feedback and two others complained of never getting item and getting a refund (one positive and one neutral).  I checked and sure enough, I received a refund two days ago.  I just left negative feedback...so ticked off.

Hmm..strange  I have only seen that message when a case had already been opened, either on Paypal or eBay??? Did you already open a case through Paypal?

Was this seller in the US?

Help please. 

Check the auction listing- what is the time period that the package is expected to appear? It will say on there somewhere (ie it might say April 22- 27th)  - if it says, for example, April 27th-  you can't file a claim until the 28th.

It was expected to be here on Tuesday (the 21st), which is why I was wanting to start a claim.  :/

It's a US seller, and no, I haven't opened a claim via paypal yet.  So I'm kinda stuck as to what's going on.  I may call eBay in a few days if the status doesn't change soon.  I mean, I expect her to mail it at some point since postage has already been paid for...right?  Ugh...I don't didn't really want to wait this long. >.<

Ugh...look at the top two feedbacks.  Guess I should have checked first.  But she had over 70 positive feedbacks with 100% rating.

Sounds like if an item doesn't sell for high enough, they are refunding people an just keeping it? :/

That's what I'm thinking.  Thus the neg.  The other auctions for the case I wanted ended around $7-10.  Super unhappy.

It wouldn't let you open a case because the seller already sent a refund before you had a chance to do anything else. Sending refunds with no contact/explanation  + other bad feedback  for similar things = dodgy seller!
