so I've hand a couple of commissions in recent times, mostly for people I know personaly.
but  I'm also starting to get  enquirers from people I don't know
and so wanted to set up some kind of  terms and conditions for working  on stuff, just to cover my bases as ive seen friends in the past  who do commissions get caught out by   difficult customers in the past and I want to protect myself from that kind of thing.

under the spoiler is the beginnings of what I have hashed out but I would like some input into if I'm missing anything or if I should be more clear about some things I already have in there.

for custom ponies the price varies depending on the complexity of the work and if I need to order anything in to complete it, for example a hair colour that I don’t have in stock or modelling compound for sculpted work.

If I need to order a product in this may also affect the working time as well, I do my best to notify commissioners of any such delays as well as showing my work in progress so they know where their piece is at in terms of completion, work in progress pictures are also posted to the blog.

All shipping is at commissioner’s expense. 
For parcels within Australia the shipping is a flat rate of $10 for small packages and $15 for larger items.
For international parcels there is a flat rate of $30 for shipping by Air mail *(10 working days approximate arrival times)   and $17 for surface or sea mail *(this method of shipping can take up to 3 months and is advised only for parcels exceeding 500g where by the cost of shipping by air becomes closer to $70 , these are changes implemented by the postal service and not something I have control over.    In the event a parcel ready to ship exceeds 500g , where it goes on to the next weight tier  contact will be made to discuss with the commissioner the best way to ship, and  additional payments to cover shipping if required. 
*(note these are standard shipping rates only and do NOT include insurance, if you require insurance for your parcels please inform me so the pricing can be adjusted accordingly

a basic custom *(includes full body paint, details eyes, cutie mark etc.  and re-hair in up to 3 standard colours) is around $30.   
This price bracket covers the following base ponies   *(G1excluding big brothers, flutters, SHS’s or other special run ponies such as glow’n’shows or ponies with twirling tails) ,G2 earth ponies,G3 , G4 *(standard brushables  and fillies earth ,unicorn and Pegasus only)

For special body shape ponies such as the G1 big brothers and the G4 alicorns *(includes both body types Celesta and Cadence)  basic custom of  full re paint and re hair in up to 3 standard colours   the pricing is $40 ,
 as more material is required for the larger ponies and both alicorns are difficult to take apart and reassemble .
special hair colours are available but will cost extra.
These colours include some metallic colours like gold and silver,  glow in the dark hair , colour changing hair in both UV activated and thermally activated.     Each special hair colour incurs an additional cost of $5 per colour used.

for more intricate customs that  include sculpting or other special aspects like the crocodile dun dee pony the starting price is  $60.  This price bracket is applicable only to larger body ponies such as G1’s , G2’s and G3’s  this option is NOT available for G4’s

heavily sculpted pieces like the Jason and Freddy pony  are  $90 to $120  and require at least a $30 deposit before work starts as in most cases I will certainly need to  Oder in some of the materials. This price bracket is applicable only to larger body ponies such as G1’s , G2’s and G3’s  this option is NOT available for G4’s
Blind bag keyrings.
these are available as a basic repaint only for the g4 blind bags.
$10 ea for the these  (includes repaint of figure and attachment of keyring)
All bases are subject to availability; upon agreement of a commission I will supply the commissioner with an image showing available bases for a project that the commissioner may select from if they so choose.

if a specific base is required but not available then one of the following may occur
.
- the commissioner has a specific base they would like used and posts it to me for working on.
this may mean some delays in working time as I would have to wait for the base to arrive before I can begin. 
-   I will seek to purchase a suitable base of the same pose as the requested base, the time it takes to find, purchase and wait for the base to arrive in the mail may affect the working time of the commission, the commissioner will be notified of any such delays if they are of a significant length of time , *( more than a week)

- I may suggest using an available bait but   doing a repose , if the custom requires a leg raised or other such modification,   all sculpt work including reposes will affect the price of a custom.

All payments are to be made by pay pal.
and all quoted pricing is in USD.

Prices listed represent an outline only and the final price will be determined by the exact specifications of the custom project.     Once a price is finalized the commissioner agrees to specifications discussed and major changes to the project after payment cannot be made.

Having some sort of ToS listed is definitely a good idea and this is looking good already! Here's a couple of thoughts. :)

What you have in there looks all valid. However, having it all in prose like that requires the reader to pay full attention while reading and they might miss something. I would give the text some structure by adding clear and concise headings (e.g. 'Shipping', 'Payment', etc.) and perhaps listing the prices and categories, i.e. what $ xx will get you. Lists are easy to read and for information like price brackets, it will help the reader to find what they're looking for if the information is always presented in the same order. For example, category name (basic/complex), price, what's included (FBR, hair), types of baits available, examples (preferably as links or images).

Regarding pricing, I am a bit hesitant about this part:

I think it's very fine to do this if the custom calls for some really unique parts that you won't have use for otherwise, a HTF bait, and so on. And the amount of material used naturally affects the price, like more/longer hair, heavy sculpting etc. But I don't think it's fair to ask more simply because you don't happen to have a specific hair colour in stock or have run out of clay. (Not sure if this is what you meant but that's how I read it.) These expenses should in my opinion be incorporated in the starting prices.

You mention deposit under one of the categories; this is something I would state/repeat under the payment section. It may also be a good idea to specify when you expect the deposit, if applicable, and the full payment (e.g. up front, within 30 days of completion, or whatever) and what you will do in case the customer fails to pay. Sadly, it happens sometimes... Other than that, I can't think of anything to add. Just a bit of restructuring an I think you're good to go. :)
