autugraphed series 1 i sold on ebay

I sold an autographed Andrea libman fluttershy card on ebay. Mailed it. Then 11 days after it was received was notified that it was not new as described in auction. It also was with the authentication sheet and the winning code card. I am trying to work with the buyer because i know it didnt have the crease on it that he is claiming it had when he received it. He said he didnt look at it before he gave it to the person it was intended for Who doesn't examine something as soon as its received?. It sat around for 11 days. I told him i would refund $10 just to avoid ebay getting inviolved . He was not happy with that and wants $35. I told him ill do $ 20 because it took so long to contact ( makes me wonder) me after receiving it and it will still grow in value. He said he'll take $27.50 or talk friend into just returning it.   It was won for $202.50. I wont get any ebay final value fees back omn partial refund. I dont except returns it would have to go through ebay and then i would get a dqmaged card back. Im not happy. Dont know what i should do.

I personally would tell him you want to see pictures of the crease before any talk of a partial refund.

He showed me pictures. My dilemma is the time span before he contacted me. Who's to say his friend isnt responsible for the damage.

I would have said that he had 7 days from receiving it to dispute the condition. and that if he can't be bothered to check the condition of items when he receives them then it's his tough bananas. After 11 days? Nah, he or his friend creased that for sure, or he's having buyer's remorse. Maybe phone Ebay and ask what their advice is, but most companies will only give 7 days for someone to bring up an issue with an item.

Will also take in Pretty Pony Club (UK magazine) fakies.

Unfortunately since this is through eBay it doesn't matter that they waited 11 days to contact you. According to eBay's Money Back Guarantee policy, a buyer can request a return no later than 30 days after the actual (or latest estimated) delivery date, or, if the seller's return window is longer, within that return window.

If you don’t offer returns and the buyer requests to return the item for a reason that’s not related to the item being not as described, you can decline the request. However, if the request to return an item is made within the eBay Money Back Guarantee window for an item that was not as described, eBay may refund the buyer and require you to reimburse them for the refund. In this case, it will count as a defect and towards your percentage of cases closed without seller resolution—unless you do ask eBay to step in and help and eBay resolves the case in your favor or the case is found to be not the fault of buyer or seller.

It really is a terrible situation and I am not sure really what the best way to handle it is. It really does sound like the buyer most likely mishandled the card before giving it to his friend but it's going to be really hard to prove.  :(

I do think after having the item so long and not checking (I mean really? you fork out over $200 for an item surely you are going to check it over right away??!! :blink: ) makes it seem like some kind of buyers remorse or he is just trying it on to make some money back possibly before selling for a bigger profit later.  I wouldn't be surprised if this person damaged the card  either intentionally or accidently - but like PL said its hard to prove.
Do you think the item would be worth that value even with a damaged card or still possibly increase in value later? because if that is so then I might be tempted to tell him to send it back for a refund - not give him a partial. It's a big chunk of monies though *sigh*
Maybe give ebay a phone call and explain the full situation to them and see what they say? :what:

I agree with Ringlets. I would ask them to send it back for a full refund. I had someone not too long ago say there was something there I had not mentioned and wanting a partial refund (there were plenty of pics and I state in my auctions that I'm human and may miss things). I told them to send it back. But they didn't want to do that. They just wanted to get the item cheaper, apparently.

Most likely your buyer is not going to want to send the item back. I'll bet even though the card is damaged, they're not going to be able to find it somewhere else.
