I've never had anything like this happen before. I bought this beautiful Mickey Mouse cell phone case and got it for a great price.
http://www.ebay.com/itm/271229911776?ssPageName=STRK:MEWNX:IT&_trksid=p3984.m1497.l2649#ht_367wt_946
The seller then shipped it out with tracking quickly  which only shows my city and zip in the tracking of course as it usually does. As of July 3rd it was marked delivered. Well, it never showed up at MY adress and I let them know but the seller is telling me it was delivered when I told them what is going on.

I went to the post office and of course they were no help at all. So now, I am out my money and have no cell phone case. it was very cheap so I won't really miss the $4, but that cell phone case I wanted SO badly. I just don't know what's fair because the error could be the seller's fault in my address, or the stupid post office could have done something with it. I just don't know what's fair feedback wise. I know that I can't leave them positive when I didn't receive my item, but I don't want to be unfair to the seller either if the error was on the p.o.

What do you guys think?

first I'd check the address with the seller, make sure it wasn't Misspelled...  then I'd go back to the post office with the tracking info printed out and see if they can track down where it went, but I don't think they'll be much help.

I did go to the p.o. monday with the tracking # and they were no help. All they said is that it was delivered. They couldn't even tell me the exsact address that it was dropped off because the carrier wasn't there. I asked the seller if they were sure they sent it to the right address and they denied that there could have been any mistake. I guess it just comes down to feedback now that it seems I'll never get my item. :(

Maybe it will show up in a day or two? Once I had something marked pending delivery even after it was delivered; sometimes things get wonky in the system.

On eBay it is always the sellers responsibility to make sure an item is received by the buyer. That's the eBay rules and one of the risks all sellers take when selling using eBay is that an item will be lost in the post, so make a claim for item not received. The seller will then have to show that it was recieved by you and usually only a signature is sufficient proof for eBay.
It is a truth universally acknowledged, that a woman in possession of disposable income, must be in want of a pony.

This is what's so messed up about this situation. I opened an item not received case and since the seller has a tracking number even though it only shows that it was delivered to my city, state and zip and not the street name and number or anything. They're covered, even though it was Not delivered to my address. The case is still open because I haven't closed it yet, but the only options its giving me is to close it satisfied or doing a item not as described. I have no clue what to do.:(

You can open a case with the post office by calling the service line (800 ASK USPS).  If it was the P.O. rather than the eBay seller, this should help.  When I had supposedly received a delivery notice (but not really) and my P.O. was unconcerned, this is what I did.  They 'found' my package that day.  Not saying that they will necessarily find yours, but it might help.  It's hard not getting what you ordered, even if it isn't expensive.   :(

What a terrible situation  :(  I would contact your seller again and ask her to please give you the exact address that was used. Just a side note though as long as your address is correct on your Paypal and Ebay account then there is not much room for error, as most sellers print their labels straight from either place. So the problem then is most likely with your mail carrier.  In which I would then probably go back to your PO and ask if they spoke to your driver yet?

I know it doesn't seem fair but as you already mentioned, as long as she has a delivery confirmation and it shows as delivered, Ebay will side with her. Because in their eyes she has fulfilled her side of the sale.

I would try what Radha has suggested though. It sounds like she had luck in locating her package so maybe it will help locate yours. Also maybe check with your neighbors. My old worthless mailman twice left packages that were mine at my neighbors. Thank goodness they were honest and brought my items to me. But that's a possibility also on what could have happened to it.

How awful :(   Its a good thing it wasnt an expensive item, but its still really disappointing when something like this happens.  It does sound like it probably is the PO/ mailmans fault rather than the sellers...  I cant add anything extra to help at theis point other than for you to definitely check with the neighbours as Ponylady suggested , and if you have no joy there, then try Radhas suggestion.  Please let us know how it goes

Thanks for all of the suggestions! The seller just said that they'd go ahead and just refund my money. I'm just really angry with usps, that they can be careless with people's mail and never willing to own up to it.

The guy at the post office gave me the number to the direct line to my carrier and left them all the info for my problem and my phone number to call me. Do you think the carrier ever called me? No. And I have been calling the number he gave me to have it just ring and ring with no answer.

I did try 1800 ask and that line seems to be fully automated and is only telling me it was delivered and when. Oh well, I'm at least satisfied with a refund.

The seller has refunded my money! So glad this turned out to be a great seller because I know that they didn't have to do that. I have left them positive feedback.
