Unfortunately ordering from Taobao is always running a little bit of a risk. Sometimes the items that are shown in pictures the seller may not even have - its pretty common to see inventory figures much higher than the actual stock levels a supplier has. Likewise you cant always trust the images a seller posts - pictures are stolen from product promo shots, other websites or occasionally other sellers.
But perhaps the main problem is that you are dealing with an agent who has no direct association with the seller or with Taobao they are simply your middle man as Taobao is impossible for someone not living in China to use and navigate a lot of the time.
This is not to say that every seller is like this - most are not - but unfortunately there are some questionable sellers on the site.
Here are a couple of considerations:
1) Where did you read that the items were "used" not simply "copies"...if the seller or your agent or the listing stated they were "used" but they then offered you "copies" instead...then you should have taken this up with the agent at the time they reached them and had them return the items to the seller. Although often returns like this can be a fight on Taobao but at least you would have been in a strong position.
2) Shipping from your agent on to you is standard - you should have been told this when you signed up to an account with your Taobao agent. Which agent did you use? It would have been very naughty of them not to put this information on their website. Unfortunately international shipping from China is often what makes "great" Taobao deals become expensive.
I hate to say it as it is incredibly frustrating but I dont think you have tons of room to move. If you paid with paypal you will struggle to win a not as described case, as your "contract" was with the agent who did tell you what they were sending. If you paid with credit card you could open a case there as well in regards the quality of the product received but likewise you may have a problem with them in so much as you knew what you were having shipped.
Even if you do decide to go ahead with a claim on paypal or on your card and win, you wont be able to claim the shipping on to yourself and by the time you package up and return the item to China you may just find yourself even more out of pocket [postage to China is not cheap] and even more upset with the whole thing.
I think you ll have to look back and decide where the "used" not "copies" information came from and go from there - as to whether the seller told you, the agent told you or you picked the information up incorrectly from the listing. Establishing that information will help if you do go ahead and try and make a claim on your payment method. And if you buy again next time dont accept the item and shipping on if the product in the picture is not the one you ordered and have already paid for.
I am sorry I cant be more help than that but when we are dealing with websites in different countries which have different methods and systems of selling, its 90% of the time amazing and 10% of the time a risk. I am so sorry you ended up in that later category this time around.
