File a claim or not to?

Long story short;
1. I advertise seeking FF ponies, a seller approaches me and sends me concave ponies. Discovery is made after second pony arrives 5 days later (this is because they are sent to my SO who is located in the US and who is not a pony collector).
2. I talk with the seller who agrees on a refund, for some reason cotton candy was forgotten to be mailed out making her a day late to be returned.
3. Today peachy was received and the seller claimed she reeks of smoke, except; no people in the house smokes AND they have been kept in their bags. The father of my SO is a postal worker of 30 years experience and treats packages with care, so I highly doubt he would sustain damages to any of the packages, as he has handled my RAOPK post with exceptional care.

So should I file a claim? I have her info if the staff are requiring that because she sure hasn't refunded me for the so-called-flat-foot peachy yet. The ponies were also not in mint condition as she stated, the one had cancer and the other marker stains.  :pout:

I am a bit confused. She sold you a pony that was not as advertised, then you sold her a Cotton Candy that she claims reeks of smoke? Is this correct? and did this happen here on the Arena?

No I asked to buy Flat Foots, she approached me and said she had two. She sent me concave ponies.
This did not happen over the arena but in a private group at facebook, but since the transaction went through paypal I figured I'd ask here for support.

if she is refusing to refund you, I would file a claim. Make sure you upload the trackng showing that it was delivered back to her house.

Thank you for clarifying and editing your post to reflect that  :hug: I would most definitely file a claim if you have been waiting that long for a refund. I would also contact the Admin. of the FB page you bought her from, so they are also aware of the situation.

How disappointing! :(  I would advise you to file a claim too-  I also agree that it would be a good idea to give the admin a heads up about this seller as well like Ponylady suggested :hug:

I notified the admins of that page already, the seller claimed she'll transfer the money when she receives the second pony. But it seems strange to me she wouldn't just refund the money for the first pony? I am aware these are two different transactions, but still is it related to the paypal fee or what?
This is totally new to me.
