I'm the one with the debt >.< I have about $25,000 in student loans left... But we both make enough to live a comfortable lifestyle. Student loans SUCK!!!! >.< Yes they do! As far as withholding tax returns you'll need to file as injured spouse. It pretty much means you are claiming the debt owed is his and not yours and you are not responsible for it as the debt was accrued before the marriage. You should get some of your tax return back at least. They will still take what they consider his part of it to put towards the debt (assuming its defaulted) but you should get half or round about. I will have to research that one I haven't heard of it. I guess we could also file married filing separately. We would loose out on the tax benefits of being married though, if I married him I would move from the 25% bracket to the 15% bracket. hhhhmm decisions. You can always invest in life insurance as well as the prenup. A prenup is great for covering you for divorce, but if one of you were to die I think it is pretty common to have to pay off what they owe too. If you get life insurance for the amount of both of your debts (or more if you can afford it), then you have piece of mind that at least you won't be struggling financially Totally, life insurance is very important.

I know for a fact we'll be paying my mother-in-laws debt after she dies. Oy. Yikes! Yes it may take the romance out of things, but its not the 1950s anymore and things sure can blind side you if you are not prepared
So very true. That's why I want to be totally upfront about everything before you decide to move forward. Who knows, maybe it would be better to wait awhile to sort a few things out. (we don't have any set plans or anything we have just been talking about it) Ooooh I can help with some of this as I deal with credit in my job. Any debt that you accumulated individually will stay individual after you get married. If you apply for joint credit that will show up on both of your credit reports but only the trade lines that report as joint. Wages and tax refunds can be garnished to pay debt but I'm not sure if they can garnish a spouse's pay....but I don't think so. As already mentioned it's not a bad idea to check with a lawyer just to make sure. Awesome thanks! Yeah I've already mentioned to him that we should talk to a lawyer first and he seems fine with it. Now paying the lawyer should be interesting. ugh... I don't think I have enough time to use that military benefit.
