This will be a fun gathering of ponyfans (of all generations) in the Northwest area!  If you are in the Seattle (the South End, right off the 5 near the West Seattle offramp) area November 3rd- or willing to drive up- please let us know!

*  Pony craft supplies! (Bring your baits, paints, glitter and maybe some sculpty so you can practice after the fetlock instructional by Salli!)

1. Generation swap!  Maybe a G1 Rainbow Dash? Or a G4 Blueberry Baskets? YOU pick!
2. I wish they had made this pony! Is there a character that you wish they had made into a brushable? Maybe you saw this character on FiM or Escape from Katrina?  Or maybe they made this cutie a blind bag or some other thing- but never a full fledged collectable!  Now is your chance! Wow us with your creations!
3. Fall or Halloween Pony!

* FiM Netflix marathon! What Ponymeet is complete without some MLP toons? (If someone has Escape from Katrina on DVD can you bring?) 

*  Show and tell!! Do you have a rare pony? Or maybe a pony that means something special?  A fabulous custom that you made or purchased? Bring them all for show and tell!

*  Yard Sale! We will have a yard sale to trade and sell extra ponies, customs, odds and ends and ponycrafts!  If you are an artist taking commissions- feel free to bring portfolios and samples! Remember- cash is easier than paypal (but I will have a computer available just in case)  :) 

*  Ponycrafts! Bring a pony to customize!  (if you have extra baits or supplies to donate or sell I am sure they will also be welcome).  Our very own fabulous customizer Salli will be giving a demonstration on adding sculpty fetlocks to your pony!  Folks can paint their baits- add sculpty features, or get ideas from friends! 

Not a customizer? We will have coloring!  Not into crafts?  No worries! There will still be snacks, board games and of course My Little Pony toons to watch!

Coloring Contest! (real MLP coloring pages/books will be provided courtesy of Shelti (thank you!) and the best picture (popular vote) gets a fabulous prize! (Vintage Euro Exclusive G1 baby, wow!)

RAFFLE! - A vintage G1 exclusive baby, and lots of other fun stuff!  (This will help pay for our next party!)  - If you would like to donate to the raffle- this will help us buy more stuff for the next Pony Party ;)

MORE ACTIVITIES
* POSSIBLE Field trip Depending on interest and how busy we get- some ponyfolk might consider a quick caravan trip to the GoodWill Outlet less than a mile away-  it is dirty and gross- but they sell toys at .50 cents a lb, and there are often ponies there of all generations to rescue-  If we go- I will provide a prize to the first person who finds a MLP!  (I will also be handing out gloves)

LOCATION:
Currently- a house on N. Beacon Hill in Seattle- just 2 blocks from the Spokane Street/West Seattle Bridge I5 offramp- also about 2 blocks from Jefferson Park.  A very easy walk from Light Rail (Beacon Hill station)- or you can take the 36 bus, the 39 bus (turns into the 33) or the 60.  The 60 stops one block from our house, but only comes every 30 minutes.  The 36 comes every 12 minutes and stops about 4 blocks away.  Try the metro trip planner:  Your destination is near 15th Ave S. & Hanford. http://tripplanner.kingcounty.gov/cgi-bin/itin_page.pl?resptype=U   

The location is about 2.5-3 hours away from Portland, OR- and about the same distance from Vancouver, CA - so we would love to see you there if you can rally!

Peruvian Cherries Jubilee- Her coloring (yellow with light pink cherries) is quite different than the US version (pink with dark pink cherries).  (for reference:http://mylittlewiki.org/wiki/Cherries_Jubilee)-  The symbol design and pose appear to be the same as the U.S. pony.  Her hair is super crispy and she has a scratch on her right eyep her head is no longer glued so can be removed (for re-maning).

2.b. Peruvian Lickety Split variant:  The photos wash this pony out a bit- but she actually has a purply body with purple ice cream cones.  The color is not as intense purple as the standard Peruvian LS- and she looks a lot more like the "brown" Lickety Split variant (particularly since she also has white mane and tail). I have been looking everywhere for them- but have only seen 2 come up on Taobao- both defective RDs.

I know that Hasbro won't mass produce something unless they get enough orders from the stores themselves- I am worried that these weren't ordered or maybe were dropped.  I suppose since they are Crystal Empire though- they still may be on the way.

What I didn't realize about this pony- was that the "drawings" are only one one side-  the other side is blank!

I also got this large color-in Rainbow Dash (other side above)- She appears to be a failed quality control pon- she is dirty and has a noticeable flaw in the center of her mane (like a bubble or something).  She is awesome! I only saw these pop up once on Taobao and now they are gone- I wonder if they will be coming back?  I so regret not snapping up a white FS Celestia when I had the chance...

I pictured her with wingless RD (who is identical to regular fs RD except the wings) to give an idea as to size- she definitely uses a different body mold.  The bottom of her foot says Hasbro 2012 (the FS ponies say 2010)

I have to say that I was not loving the G4s when they first came out because although cute (and preferable to 3.5s) they really don't look like ponies (look more like deer or something).  I did get over it obviously- now I think they are super cute.  I think of them more as anime-style ponies :D

Early this month (the 10th) I won this auction. http://www.ebay.com/itm/150875378410?ssPageName=STRK:MEWNX:IT&_trksid=p3984.m1439.l2649    I was very happy since I kept missing out on this cutie, and wanted her so bad.

I didn't get her right away which I thought was odd- since I had paid immediately and the shipping fee was $11.35 for expedited shippingg.

I checked the seller's feedback and it looks like she has an issue with slow shipping. Since I still wanted the pony BAD I sent her an email asking politely about when or if my package had shipped- please?  I then received an update notification showing that the seller had shipped and provided tracking info. I thought "Oh- she just forgot or is lazy- WHEW!" Or so I thought.  Four or five days go by and no pony.  I clicked the tracking label and it said that the package was still "expected" (not scanned).  Sometimes this happens so I emailed again. No response.

The next day I opened a claim with ebay- explaining the situation politely (hoping the seller would get the hint and mail the pony).  She finally contacted me and was so sorry, but she had accidently sent my pony to someone else- and hadn't even realized it until that day.  She offered to send her own pony to me while she waited for the other pony to return.  I was super happy and told her that I totally understood the mistake - and for sure wanted the substitute pony.  Five more days go by and no pony. 

Yesterday I contacted the seller again to let her know that I hadn't received the replacement pony yet- and was wondering when or if she had sent it? Please?  No response.  Today I finally "escalated" the claim to ebay since it looks like my situation is hopeless.  Ebay sent me a refund.  I was disappointed. While I'm happy I didn't get ripped off- I really really really wanted the pony. 

I just left negative feedback- if the seller does ever send the pony- I will pay her again and revise the feedback.  I hate leaving negative feedback- but I feel like in this case- it was probably deserved. :(

The seller's name is killakalani.  Her name is Nora M- she isn't a member here, is she?  If she is- I do still really really want the pony and would still pay for her... :cry:

A few months ago the need to went through one of those periods where I have to get rid of STUFF! I poured through my crafty/toy room, rooted through the basement- and combed through the pony bins to take out all the ones that weren't absolute favorites.  Everything went into bags to await the next trip to the thrift store (I know I know, but I didn't belong the board then)

Unfortunately, once we loaded everything up into the car to go- I looked in the pony bags (big mistake) and realized how awesome the ponies were that I was about to lose! I honestly couldn't even see what I was thinking - and re-rescued all of them.  At least everything else went to the thrift store- but the ponies are safe and sound again.

Do any of you ever get the feeling that you have to shed stuff like crazy- only to change your mind or regret it later?   It seems like I do this a lot.

I got a new Celestia and wanted to see how she looked with some of her Celestial friends.  I will admit that the big talking Celestia is cute, but my eyes bulge a bit every time she says, "My hair is so pretty!"

I suspect strongly that the 6" white one may be an EP or design that Hasbro scrapped for the Crystal Princess collection in favor of the pink version (also pictured).  I wish I could get the white FS Celestia (another scrapped design I suspect) but she sells out every time a new lot is posted on Taobao.  That place sure is getting crowded...

Hi ponyfriends.  I recently became aware that there seems to be a lot of misinformation and apprehension out there about whether or not something (particularly fan art) violates copyright law.  Surprisingly- I actually know a little about the issue - and would love to share - particularly if you are an artist worried about infringement issues. Unfortunately, my knowledge is limited to U.S. law- so if you are an artist in the U.K.- I can't help :P

ALTERNATIVELY- if your attention span is short or you just aren't in the mood (or my post is incomprehensible)- Bronley was kind enough to point out this very nice blog post- which I thought did a very good job of summing the issue up in an understandable way. http://www.plagiarismtoday.com/2010/05/13/the-messy-world-of-fan-art-and-copyright/

Still there?  Still awake?  Okay- so I want to set the record straight as to the alleged “fan art clause.”  There is no such thing.  Copyright infringement/violation suits arise out of the Copyright Act of 1976.  There is no amendment or clause to the Act or any other statute that I am aware of that speaks specifically to “fan art.”  That said, if someone does come after you (in the U.S.), claiming that your work is derivative of their copyright (ie your plushie of Twilight)- you can and likely will raise the “Fair Use” affirmative defense.  That said- unless you are actually causing harm to the owner of the copyrighted work- you are VERY unlikely to be sued.
Here is an example.  Lets say you started producing a small plastic pony called “My Little Brony.”   IF you sold a few thousand through DA or your comic book store- Hasbro would probably not care- particularly if it looked as though the product was fueling the market/madness for MLP products.  However, if their attorneys/marketing department decided that your product/sales were a) having a negative effect on brand image or b) having a negative effect on market sales (ie people buying MLBs instead of MLPs) Hasbro would probably send you (or more likely DA and your comic book store) a letter asking that the product no longer be offered for sale through a commercial venue.  If you thumbed your nose at the letter- AND Hasbro decided that you really were causing harm- Hasbro could file suit in federal court to stop you. 
You would then need to decide whether your infringing work is a “fair use” of Hasbro’s MLP copyrights based on the four factors discussed below.  The Court will weigh EACH of the four factors and no one factor is determinative (including the factor discussing commercial use). 

FAIR USE factors, quoted from the seminal case Campbell v. Acuff-Rose Music, Inc., 510 U.S. 569, 578-79, 114 S. Ct. 1164, 1171, 127 L. Ed. 2d 500 (1994):

FIRST FACTOR  (commercial use factor)

Quote
The first factor is “the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes.” § 107(1). The enquiry looks to whether the use is for criticism, or comment, or news reporting, and the like, see § 107. The central purpose of this investigation is to see whether the new work merely “supersedes the objects” of the original creation, Folsom v. Marsh, supra, at 348; accord, Harper & Row, supra, 471 U.S., at 562, 105 S.Ct., at 2231 (“supplanting” the original), or instead adds something new, with a further purpose or different character, altering the first with new expression, meaning, or message; it asks, in other words, whether and to what extent the new work is “transformative.” Leval 1111. Although such transformative use is not absolutely necessary for a finding of fair use, the goal of copyright, to promote science and the arts, is generally furthered by the creation of transformative works. Such works thus lie at the heart of the fair use doctrine's guarantee of breathing space within the confines of copyright, see, e.g., Sony, supra, at 478-480, 104 S.Ct., at 807-808 .

However, the Supreme Court makes it clear that commercial use is only one factor to consider- and just because something has a commercial nature- does not take it out of fair use:

If, indeed, commerciality carried presumptive force against a finding of fairness, the presumption would swallow nearly all of the illustrative uses listed in the preamble paragraph of § 107, including news reporting, comment, criticism, teaching, scholarship, and research, since these activities “are generally conducted for profit in this country.” Harper & Row, supra, at 592, 105 S.Ct., at 2246 (Brennan, J., dissenting). Congress could not have intended such a rule, which certainly is not inferable from the common-law cases, arising as they did from the world of letters in which Samuel Johnson could pronounce that “[n]o man but a blockhead ever wrote, except for money.” 3 Boswell's Life of Johnson 19 (G. Hill ed. 1934).
SECOND FACTOR  (news/journalist factor)

The second statutory factor, “the nature of the copyrighted work,” § 107(2), draws on Justice Story's expression, the “value of the materials used.” Folsom v. Marsh, 9 F.Cas., at 348. This factor calls for recognition that some works are closer to the core of intended copyright protection than others, with the consequence that fair use is more difficult to establish when the former works are copied. See, e.g., Stewart v. Abend, 495 U.S., at 237-238, 110 S.Ct., at 1768-1769 (contrasting fictional short story with factual works); Harper & Row, 471 U.S., at 563-564, 105 S.Ct., at 2231-2233 (contrasting soon-to-be-published memoir with published speech); Sony, 464 U.S., at 455, n. 40, 104 S.Ct., at 792, n. 40 (contrasting motion pictures with news broadcasts); Feist, 499 U.S., at 348-351, 111 S.Ct., at 1289-1291 (contrasting creative works with bare factual compilations); 3 M. Nimmer & D. Nimmer, Nimmer on Copyright § 13.05[A][2] (1993) (hereinafter Nimmer); Leval 1116. We agree with both the District Court and the Court of Appeals that the Orbison original's creative expression for public dissemination falls within the core of the copyright's protective purposes. 754 F.Supp., at 1155-1156; 972 F.2d, at 1437.
THIRD FACTOR

The third factor asks whether “the amount and substantiality of the portion used in relation to the copyrighted work as a whole,” § 107(3) (or, in Justice Story's words, “the quantity and value of the materials used,” Folsom v. Marsh, supra, at 348) are reasonable in relation to the purpose of the copying. . . Attention turns to the justification for the particular copying done, and the enquiry will harken back to the first of the statutory factors, for, as in prior cases, we recognize that the extent of permissible copying varies with the purpose and character of the use. See Sony, supra, 464 U.S., at 449-450, 104 S.Ct., at 792-793 (reproduction of entire work “does not have its ordinary effect of militating against a finding of fair use” as to home videotaping of television programs); Harper & Row, supra, 471 U.S., at 564, 105 S.Ct., at 2232 (“[E]ven substantial quotations might qualify as fair use in a review of a published work or a news account of a speech” but not in a scoop of a soon-to-be-published memoir).

FOURTH FACTOR  (harm caused by your use)

The fourth fair use factor is “the effect of the use upon the potential market for or value of the copyrighted work.” § 107(4). It requires courts to consider not only the extent of market harm caused by the particular actions of the alleged infringer, but also “whether unrestricted and widespread conduct of the sort engaged in by the defendant ... would result in a substantially adverse impact on the potential market” for the original. Nimmer § 13.05[A] [4], p. 13-102.61 (footnote omitted); accord, Harper & Row, 471 U.S., at 569, 105 S.Ct., at 2235; Senate Report, p. 65; Folsom v. Marsh, 9 F.Cas., at 349. The enquiry “must take account not only of harm to the original but also of harm to the market for derivative works.” Harper & Row, supra, 471 U.S. at 568, 105 S.Ct., at 2234.  Since fair use is an affirmative defense, its proponent would have difficulty carrying the burden of demonstrating fair use without favorable evidence about relevant markets.
