I purchased this lot of ponies from closetspacetoys on May 30:

As you can see, there are a lot of fakies and McDonalds ponies, but there were also a few decent G1's and a Fairy Tails bird in there. I paid the next day (May 31), but the seller did not even ship it until June 9.

Then today I received an email from the seller saying that they "couldn't find" some of the ponies, so they sent what they had. They also said they were giving me a refund, which I still haven't received.

I got the box today and all that is left is the fakies and McDonalds ponies. Oddly enough, all of the G1's (and the FT bird) are the ones that the seller "lost". Funny how that worked out, isn't it? *sigh* I am so mad.

I sent them a message, and left a negative. I hope they will at least refund me, but if not, I'll open a case against them through Paypal. I just wanted to warn people to avoid this seller.

I suppose technically they did get away with it... but I'm not going to make it easy for them. *shakes fist* :D

It looks like the lot is supposed to mostly be G1s! I would be angry too if not a single one showed up! However, I think you jumped the gun by already leaving feedback. You should have automatically filed an item not as described case stating items were missing. Now that you've already left feedback, I'm not sure if a case would hold up.

you can keep an eye on his auctions and see if he relists them, then you can at least report him or call him a jerkstore or something.

:blink:  that's bad!  and it looks deliberate :(  . I think they deserve the neg of course but you really do need to open a case on them. I'm not sure if that is possible now or not without checking ...but definitely call ebay  or email them or both  and let them know exactly what has happened with this seller. If you cannot open a case they may be able to make it so that you can and investigate this seller/advise you what to do next. Also I think you can still open a case with Paypal even if you cant on ebay.

with all the other stuff that they have listed, it's pretty obvious they either know the value of the toys or do the research necessary.
so i'm guessing they were upset that the listing didn't go for more.

I was able to open up a return request through eBay even though feedback had been left... I haven't had a response from the seller yet though. I will keep you all updated if/when I hear anything.

Wow, there's even more negs now than there were when I left mine... those two on the top are new since last night. Dang. And I still have not heard a peep from the seller. I want to get my refund... should I call eBay or Paypal? I've never had to bypass a seller like this before.

You need to open a paypal investigation-  you can do it through either paypal or ebay- although I also would suggest ebay as they can get only so many strikes before losing selling privileges.   Make sure you save the emails, attach them as exhibits.  Take a photo of the ponies you received vs. the pictures in the auction.  Save the pictures from the auction- take a screenshot too - as the photos/auction disappear fairly quickly.

This :nod:  the fact that the seller has a number of negs and even some new ones, as well as not responding to your request to return the lot , is not going to go down well for them. You should definitely get a refund  via ebay and perhaps ebay will actually do something about this seller (we can be hopeful right?).
If ebay doesn't do anything you can still open a case through Paypal

I just wanted to update everyone... I found the seller's Facebook page. It turns out they have an actual store in Indiana. Anyway, I sent them a message through Facebook and they FINALLY refunded me, but I still won't ever deal with them again.

Anyone want any fakies? :D

Yes this is an actual store near my house. I visit them occasionally. That Gusty has/had been around forever and was horrible stained, so you're not missing much. All of their ponies in the actual store have been very overpriced for the condition.

I'm glad you finally got your refund :bigups:  I didn't realise that this was that store :blush:   They should know better then!
slightly OT but I'll pass on the fakie offer lol - mom has waaay too many already :P
