Hi!

I thought I'd share this ebay-hassle too... I'm starting to get fed up, 3 scams in a year :(
And all are made by good-feedback people... Two here, one  on ebay.

Here is the most recent one on ebay:

I bought this ~30 pony lot from Ebay.de. I asked for shipping costs, and was told 17 € (this is dhl with tracking).

I bid and won. The seller wanted bank transfer so I asked for the IBAN-number. The seller took his/her time and when I received it , I wasn't able to pay (my bank stuff was in different place). I told the seller I will pay in a few days. He /she opened a case which I understand. I made the payment and the seller send me a thank you note. After few days, I got the standard mail from ebay that my order has been shipped.

I waited around two weeks and no package. I asked the tracking code and the seller answers that he/she didn't get a tracking (with 17 € you will get tracking!).

I opened a case but ebay says it  is not valid 'cause "the item was not covered with ebay-cover".

Yestrday I connected the ebay customer service because I noticed the same seller is selling the same ponies, but in smaller patches o_O

Rude and awful. All this time the seller haven't responded my or ebay's messages :(

Has anyone else been in the same situation?

Edit: this happened in ebay.de and the seller is ichbindererstejaodernein

Hmm tricky.. Unfortunately as it was a bank transfer it doesn't cover you this is y we only deal with PayPal even if the seller asks us to pay with bank transfer we say unfortunately no we only use PayPal.

I don't think there is much you can do.
Only thing mum suggested is there any way to prove the ponies in the bundle you brought are the same ones she has split up? Like is there any noticable marks or hair cuts on the ponies to prove to ebay that they are the same ones. (otherwise ebay will say they could of had more)
 It is worth contacting ebay and telling them.
It is completely out of order of the seller :( :hug:
Can you tell us all her ebay name? So we can know not to buy from her/him

I added the name above.

I tried to check the original listing earlier but it has disappeared :(
But I'm quite sure they are the same ponies and the silence speaks for it self.

Edit: The reason I say he/she is that the two messages I have received were signd by different people, Chris/Sandra.

Edit3: You can clearly see the Merry Treats with cut hair and Sky Rocket too with flaws... And too many same ponies :(

Gonna have to say I agree with you there! I would contact ebay with proof of payment, screenshot of the 'shipped' status, and then comparison shots and links to the past and current listings. you are being scammed.

No, I haven't because my case is still open :/ I'm in a dead end, Idon't know what to do next.. I can't find the place where to take the case to the customer service and I will certainly not drop the case before I get an answer from ebay.

I emailed the customer service but they haven' t replied yet.

I'm not that good at germany and the case page is in German...

I agree there are a bunch of the same ponies from the original lot you won listed.  >_<

Unfortunately Lollipop is right, although Bank Transfers are the norm on ebay.de i.e. PayPal isn't compulsory, you won't be covered under eBay's  Buyer Protection policy.

Was your lot won on December 15th? Just curious?

She has sold a lot of ponies so I think they do have a lot of doubles.

But yes the 2 you said are clearly your ones especially Sky Rocket I can't tell with the other ones there are other ponies listed too that arnt in the bundle you got

Its defiantly not right though.

I agree with stormness take a screen shot & send it to ebay and point out that it is your ponies in the listings she is selling atm.

I hope they can sort something out for you :( :hug:

Siiri have you rung ebay? Mum said she gets better answers from them when she actually rings them up. Might be worth doing that.

Yes there is other too.. And I have bought from this seller before I think but I think there is something fishy  here. I have had 0 answeres :(

Edit: I have thought about ringing but I'm afraid they wont speak english :( I know a little bit german but not enough for this :(

That is why I think they aren't answering from the cust.serv. to me :/

Hmmm

I think all you can do is take all your evidence to ebay ... like the screen shot ... & photos of the ponies

Hope they can sort it out for you  :(

The reason I asked about the date is because it has been over 60 days and it may also be the reason they are not allowing you to escalate the case.

I agree with calling them. I think it is going to really be the only way to get them to maybe do something about it.

Hmm yes the 60 day thing could be an issue but if she only sent it around 2 weeks ago they might be able to do something.

You might need to show them the messages between you two as well.

Definitely ring them though will be easier for you to explain & you will get straighter answers.

I opened the case 28th of Jan but I don't think I ever managed to "escalate" my case.. 

Hard to do things when they arenot on your own language.. If it was english I think I'd be fine but...

Such a frustrating situation!  :( Maybe you could pm some of our native German speaking members to help you with this? I hope it'll turn out for the best in the end.

I got a reaction from the seller! I sent a message that the Merry Treat  looks thr same in my lot and I will send pics for ebay.

Here is the answer:

"Nein ,es istncht das selbe Pony ,dieses habe ich selber erst vor 3 Tagn selber die Haare geschnitten Das kann nicht seinDann schauen sie die Bilder nach "

Why would he cut the hair himself?

If there is someone who can translate this I would be happy! I don't think I understood it right :/

If he has said he has cut the hair himself well I dont think so they have sold a lot of ponies they obvs no the value so I dont think they would of cut the hair on 2 ponies that are the same short. Did you point out sky rocket too? think that is a more obvious one as why would the same 4 front plugs be cut at the front....

Very odd....  :(

Google translated it to this for me....
"No, it is not the same pony, this I myself have cut themselves hair just before 3 tagn This can not seinDann they look at the pictures after"

If he is saying it cannot be seen in the pictures point out skyrocket to him as you can definitely see that one.

Just saw this sorry, Ebay do have english speakers in every country they have to so don't worry, just try lay everything out infront of you ready, that you want to tlk to them about or write a list so you dont forget what you want to say to them

Is there anyway you can open a case up through your bank to recover your money? I know here in the US, banks support their customers if scams happen with proof. And you clearly have proof. Goodluck!

This is actually what I was going to suggest. It will depend on your banks individual terms & conditions in regards international transfers as well as your type of account and if it has insurance included within it. But it would be termed as fraud and for that reason most banks will take an interest of some kind. At this stage unfortunately due to the time since the sale and that you paid bank transfer, ebay could well wash their hands of the situation. So its worth trying a different route. Even if so that you can perhaps let ebay know when you are talking to them that you have referred the transaction [through their website] to your bank as fraudulent.
