Title: Help with paypal dispute?

The amount of bad luck I've had so far this year is unreal! But anyway, I bought 6 ponies from a member here on Jan 15th, which I still haven't recieved. I have emailed them a number of times and tried contacting them on facebook, and they've been online and are just ignoring me. I opened a claim 4 days ago.
So How long do you wait to escalate? I also (stupidly I guess) bought more ponies from them 2 weeks ago, which havent arrived either, I know stuff can take longer than that but I've gotten items from the US this week which were mailed last week..and because of the circumstances it seems a bit fishy..lol
Should I open an item not recieved for these too or leave it lie? thanks for help!

I'd say open a not received case. Since it may prompt a response from the seller.
Although its pretty terrible that it would take something like that! :( for them not to arrive now for over a month I think something is up! I don't think you have anything to lose with opening another case :)

I'm sorry for all your bad luck...on the good side I know some ponies are on their way too you soon ;) Hope this helps!

Oh almost forgot...I know there has been some terrible weather in some parts of the US but if the seller isnt from these places then it does seem odd

Well see they didn't respond to the first one, and I thought maybe they were away or something but their sales website says that they've been online...its not a huge amount ofmoney but they were ponies from my wantlist, its just disapointing! :P

I would send them another message informing them that you are opening paypal disputes to cover yourself since they can't seem to find the time to reply to you. If the ponies show up, you can always pay them later. The lack of communication is just horrible though. I HATE when people don't answer me. I know sometimes messages get lost or you get distracted.. But it shouldn't happen repeatedly.

How disappointing for you :(    I know international shipping times can vary, and sometimes mail does get delayed...but the lack of communication is very worrying - especially since you already opened a claim some days back, and there has still been no response.   I would go ahead and escalate it, and explain to the seller in the message , that the ponies have not arrived and since you had not heard from the seller you felt it was best to open the claim to protect yourself. Let them know that if/when the ponies arrive then you'll be happy to resend the payment .  If the ponies arrive before the case is decided then you can close it. If they arrive after you've been given a refund, you can always resend the money to the seller then.
with the second lot of ponies, I would wait a bit. 2 weeeks is not a long time to wait for an international transaction - I'd wait another 2 weeks before going any further with that one (unless of course the seller really turns out to be dodgy or more bad stuff about them comes to light in the meantime - if you want to Pm either me or Ponylady the ID of your seller, we might be able to help a bit more. If its someone known to be dodgy then we can let you know to open the second claim sooner  :hug:

I agree with Ringlets, if they are unwilling to communicate then the case should most definitely be escalated.  They know the case has been opened and should have responded to that even if they were unwilling to communicate otherwise.

As for the last transaction with them, I would maybe wait a week and proceed.  Although if the first set did not arrive it is rather worrisome  :cry:

Okay so a wee update...
She got in touch with me, saying that she has sent three emails trying to get in touch with me. I can't find them at all but anyway, shes friendly and I don't want to think bad of her so...!

I sent her some extra $$ for shipping, she messaged me again though to say paypal is holding funds because of the dispute I opened and would I close it? I've no reason to doubt she mailed the ponies at all and despite the mix up I actually would like to buy from her again, shes sound to talk to and has many I need ;) Should I just close the dispute? I'm inclined to because I don't want to be the cow here...lol!!

If you close the dispute I don't think you an open it again. If she's just pretending to be a good person and you close it and she doesn't come through, then you might be stuck.

I would ask her to refund the money first, close out the case, an start a brand new transaction. Then if anything bad happens you still are protected. If she is as nice as she seems, then she should be ok with that.

I would not close the case. If you do, it cannot be reopened and you may end up stuck with no money and no ponies.

I am not saying your seller is a bad person but no matter how nice they seem, you have to protect yourself.  And that is a fact  :huh:  If the first set of ponies were indeed shipped then they should arrive to you soon enough I would think and the case can be closed then.

Why did you send her more money though?

She was short on the shipping costs because her website doesn't calculate proper shipping

So you bought the ponies in January and now it's march. You never received them and never heard from the seller till you filed with paypal. Now the seller wants you to close the dispute, so they can have access to the money that paypal put a hold on.

To me that sounds like it could be a scam. They had over a month to ship the ponies before you filed the claim, so why didn't they?? Now the money is being held by paypal and they want you to cancel the dispute. Sounds dodgy to me. Plus you said you sent more money for shipping, so therefore their claim is invalid. I would not close the case.

And yes, the USPS raied shipping by about 60% last month. It cost me $25 to ship three G3's to the UK and a single fairy tale bird was $12 to Sweden.

Have you checked their feedback here?

However, it is possible that they are still in the mail. I sent a package to hathorcat a few years ago and it was about 2 months before they received it. It is possible they sent the ponies but I still would not close the dispute. If they are lying then you are crap out of luck.

I'm sorry, I probably missed a few points! No I never heard back from her at all since payment in Jan, she only finally replied on Saturday, and said she had mailed out Friday (just gone, the 1st) so theres no way they'll be here for a week anyways..

So no its not an issue of them lost in the mail..

I think she has 100% feedback here but shes banned over at the TP for trading issues. I guess as long as they turn up I'll be happy...nothing more annoying than finding a few ponies from the wantlist and being let down..!

I agree with others. Do not close this case.  Once you have received your ponies from both transactions, you can then drop the case.  For now, you need this case to be open in case you do not get your stuff...no seller should try to manipulate a buyer to close a case  before that person has their merchandise.  Thats just very fishy to me.  Anyone can be nice in an email and say they are going to do something in an email...doesn't mean its true.

I agree with whats already been said - although she isnt a scammer (or at least she hasnt been in the past),  it doesnt matter how nice she is, you dont want to take any risks by closing that case  :awake: . What was she thinking waiting for so long (and with no contact until recently) before she sent out those ponies anyways? and asking for more money and so much later too  :(

I would still wait till I have the ponies in hand before closing the case, just to be on the safe side. Hopefully you will have them soon. The last items I sent to Europe took about 2 or so weeks minus the one I sent to Germany, that took like 2 months.

Just a bit of an update..

I still havent recieve anything so I decide to escalate today. I'm not sure if Im jumping the gun a little, but time is running out on the 20 days to escalate, and I got packages this morning that were mailed Wednesday lasy week. If they do appear I'll of course repay her, I'm not a thief :)

I feel very upset over this whole thing really because despite the fact this is two months nearly going, I was still giving her the benefit of the doubt, and there are so many ponies from my wantlist that I wanted :( Joys of it!
I feel lkke a bit of an idiot for sending the other money for the shipping last week!

God almighty..just got a long email going mental at me for closing the claim..not quite sure how I'm the bad guy in this? I simply replied that I would repay her if and when I recieved them but all in all what a headache :/

I would post her ID so that LBS can add her to her Bad Trader list, although I think they are already on it.  :huh:

There is not a single thing you did wrong so I would not worry about it.

Why? it's her responsibility to make sure her website is charging the right price for shipping. This could have all been avoided if it was. As a seller myself, I would have eaten those extra shipping costs because it was MY fault that the website did not charge you correctly. It happens. You should have had those ponies long before now.

You said she was a member here. She is more then welcome to tell her side of the story on this.

I agree with what everyone else has said! Its really not your fault and nothing you did wrong! You've been MORE than understanding! Hopefully this person will be investigated and everything will work out somehow!
Its always good to keep hold of evidence of dates etc! You're doing all you can :)

Aw you poor thing! Hormones definitely dont help at all! Im terrible at certain times...the littlest thing and im in floods of tears...poor boyfriend doesn't know what to do! (sorry I went a bit off topic)

Oh man this is taking a turn for the worse. I'm happy you didn't close the case, you are NOT the bad guy here! I feel awful for you! Grab a cup of tea, relax and know that your pony friends are behind you on this. *hugs*


If she didn't get a response from the "3 e-mails" she sent she should have contacted you elsewhere, here or FB, that's a really poor excuse on her part. It's not like you're hard to track down. There is no way this will ruin or tarnish your reputation. If anything the e-mails bullying you into closing a case (you were VERY patient before making!) is tarnishing her rep badly and the threats of ruining your rep are 100% empty, cannot be done.

I didn't want to bring her name into it for the simple fact I wanted to give her a chance to rectify it, but shes just been so unfriendly..anyway, its Jeanne Delaney is the seller, shes just Jeanne here I think but shes not too active!

Like I say I bought from her before not a bother! But its like escalating the claim has opened a big can of worms :( I'll feel like an awful idiot now if they arrive but like I say I'll pay her straight back and I'll update the thread..I wont just disapear and make her look bad :)

They've been around long enough to know this- you have money from a customer and still have the goods and an e-mail didn't get a response, you PM them, or ask someone else to point the buyer to their direction. It's also poor form to ask for additional shipping money after you told them a shipping price and the item/shipping is paid for. Been there done that, I eat the cost and if a buyer notices and PayPal's me the difference I'm super happy and appreciative, Otherwise it's a learning experience to be more careful in the future.

Ponylady/Ringlets Depending on the language used and threats with the PayPal correspondence can Saoirse also report her in some way with PayPal?

Don't feel like an idoit, if they arrive all you have to do is repay her.  ;) So many people get burned for closing cases without receipt of the item, you're just being smart here.

I am sure you can call Paypal and forward the messages to them.  But to be honest I am not sure what their policies are concerning it.  I know with ebay it can compromise the sellers account. So whether Paypal will do the same I am not sure  :huh:

Saoirse I would not engage in any future correspondences with her until your ponies show up.  Unless of course she cares to come here and explain her side.

Well she hasn't mentioned the thread to me at all so whether shes reading or not I don't know..?

She seems so upset so I'm just going to take your advice and not email her back unless the package appears..I don't want to add fuel to the fire as such! What should I be expecting at this stage from paypal, I've escaled and it says 'being reviewed by paypal'. In all my years of buying I've never had to open a dispute and follow through with the whole thing :(

Oh I swallowed the cost of shiping before myself FF.. pain when you underquote but joys of selling I suppose!

This is all so rediculous! Hopefully things will get better.

If you bought your items in January and haven't received them- that's redonkulous. Period. There is no reason under the sun (unless you're living in a broom closet at Hogwarts) that you shouldn't have received them yet. Period. They have your money- you have no ponies..unless they make with the ponies, we have nothing left to assume she's not a thief. Period.

Hun- I'm hoping you get your ponies... I'm sorry everything is panning out like this-- hopefully this person will make with the ponies VERY quickly so you can get on havin a wonderful life...you know?

You seem sweet- you don't need any of this nonsense in your life.

Ah..I feel a little better than I did earlier which is something..I just let it get to me a bit much..damn hormones! ;) I'm just going to have to wait and see how it pans out..or what paypal decides I guess! I don't want to say shes lying and didn't post because it would be frustrating the other way around but...yeah hopefully the postman will have a parcel for me at some stage!

I've seen it happen to a LOT of people that have screwed me over - its actually really surprising!

Let us all know how it goes! I really hope you receive all the ponies though...nothing cheers me up like pony therapy!  ^.^

UGH not her AGAIN!  :(  All of the Delaney family members are already on the Bad Trader List and has been for over a year... 

I'm so sorry to hear that this happened to you.  She is a very active seller but she has some bad habits since she does sell in such large quantities.  You can search the forum to find out more.

*nods*  yes she is already on the bad trader list - which is a shame since she and her family have been part of the pony community for many years , as you know, so of course she has a lot of experience selling ponies and she should know better than to treat her customers badly :(   If she is sending nasty emails then  I wouldnt respond to her messages any more hun- let the case run its course and get your refund. You already explained to her that you will pay her back if the ponies show up.
I know its hard but please try not to let this get to you - you havent done anything wrong :hug:
