Title: problem with a seller on Ebay ( kaoru_deg )

I'm having problems with a seller again and maybe you can give me some advice?
 
I bought a G1 baby on Ebay at the beginning of march, paid the day the auction ended (via Paypal) and didn't hear anything for about two weeks. Then I got a message from the seller's brother (so he said!) that his sister had an accident and was in hospital. He would look after her auctions now and would send me the pony.
 
Of course I was okay with that and was understanding. Family comes first, I said, and told him to take his time, but please mark the item as shipped when he had shipped. He did so on March 19th. Ever since I had no communication and I haven't received the pony.
 
A few days before the Paypal deadline ran out I send him a message asking for my item and when he didn't reply after some days I opened a case. The seller didn't respond again and just before his deadline was up, I received a nasty message. He or she, I don't know if it's the real seller or her brother, stated that he/she had sent me dozens of messages stating that the pony had been returned to him/her twice and that he/she is not willing to ship again.
 
I have never received a message from this seller! There is none in my Ebay inbox and there was none in my Paypal address mailbox. So he/she must be lying about that. Can I prove this to Ebay? Can they at least check my Ebay inbox?
 
I requested tracked shipping, so he/she must be able to provide a tracking number to prove the story, right? I also checked my address provided on Ebay and on Paypal, they're both correct. So I haven't done anything wrong, have I?
 
Do you think Ebay will side with me? What will happen if he/she put the wrong address on the package? That's not my fault, is it? I wouldn't have to pay the extra shipping, would I? And what can I do if Ebay sides with the seller? Am I allowed to leave a negative or a neutral then or is this against the Ebay rules?

ebay AND paypal will not be on the side of the seller if he has no prove for his shipments, i had such a case too and i won because the seller had no prove of shipment. and if he had put the wrong address on the package and you had the right one in your paypal and ebay accounts its also his fault.

Yup, ebay can see all of your communications, so they will be able to see that they never sent you any messages. You'll be a clear winner in this case, so just ride it out and let ebay/paypal settle the dispute.

I can't agree more with what the others have said.
 
If you have double checked your addresse's and they are correct, then the blame lies in the hands of the seller that she screwed them up. 
 
But I have to wonder why she did not refund your money if the pony came back to her and she could not get ahold of you.   :tellme:   It seems a little dishonest to me. 
 
I wouldn't sweat it though ebay will most likely side with you on it.  She is going to have to show proof of shipment and they will look into the emails if there are any?  So the odds are most definitely in your favor.  But whatever you do, do not close the case or pay any extra shipping.

so many people on ebay seem to think its ok to send nasty messages these days *sigh*  How odd that the last (nasty) message got through, but the other ones your seller supposedly sent didnt?! :huh:
*hugs* :hug:  I'm sure ebay will side in your favour and sort this out. It all sounds a bit dodgy to me! ebay can (and will) check the persons messages to you and from you to them. You can also leave appropriate feedback ;)

eBay and Paypal in general are EXTREMELY scummy and will side with the buyer 99% of the time no matter what other factors come into play. I wouldn't worry too much about getting your refund, it will happen if you nag them enough.

I'm waiting on a reply from the seller at the moment. She takes her time...I really don't understand how you can sit around and do nothing when there's a case open on one of your auctions.

Oh, and I have another question: The Ebay page of the open case says that it will close automatically on May 11th. What happens if the seller doesn't reply until then?

Yes you can and you should do it!
 
Anybody make faults and it can also happen that a package came back to the sender for any reason - but 2 times ?? I think that sounds a but unreal.
And when the seller really has a proof of shipping with trackingnumber he had also add it to paypal when you opebend the claim.
 
But at least you got your money back from paypal/ebay.

I am glad to hear the case is closed and you have your money back.
 
I would usually favor towards the neutral or even a positive in this type of situation if she had handled it professionally.  But she didn't!  She put the blame on you and refused to reship the item.  And further more she didn't even try to fight the case, when all she would have had to do is show some kind of proof she it least tried to ship the item.  Which leads me to believe she didn't ship it at all.  So to sum it up I would definitely lean towards the negative.

I only see this topic now.... and i also bought a pony from this seller (which did not arrive) :(
I think i've been waiting for over a month now. Im so noobie at Ebay, don't know what to do with opening a case, when needed.
Coinsidence is i emailed said seller today to ask when my pony was shipped. I haven't heared in the time between payment & now.
What should i do :( i feel really sad after reading this...... :depressed:
The pony i bought was supposed to be a present for my sister. :yikes:

I would wait till the end of the day to see if she responds. 

If not I would open a case immediately.  That may get her attention, doubtful but worth a try.

I just came to read Naraya's topic about her problem with a seller on Ebay. I knew emmidiately i have done business with the same seller.
I bought a pony and it was never received. Im a little emotional at the moment, so please let the following info Naraya gave speak for itself.
I've been waiting a long time for this pony, while other packs from the same country DID arrive while they were purchased MUCH later...

Im scared im too late to open a case or so. I just emailed the seller today, as i didn't read Naraya's topic before. Im scared this is a very BAD seller, as her story is so far the same as mine. Im losing hope to get the pony i bought.
It was supposed to be a gift for my sister. :depressed:

Im only a buyer on Ebay and i really don't know what to do when these things happen. Please someone offer me advice.
I know it's so cliche but i can't understand if people do this. I know i could NEVER do such a thing.... *sigh*

I will and i think, if it ends ugly, im gonna give the ebay name to list on bad Ebay list (i think LBS does that list?)
because 2 persons had this, it's too shady. I dont trust this person anymore.

Oh Naraya, i'd say leave neg because ... well, what's a reason NOT too?

Like I said I would give her till the end of the day to respond.  If not open that case immediately because I am assuming from what you said your pretty close to the 45 day mark to open a claim. 
 
I would not have any worries about getting your money back.  She did not respond to the OP's case, so I will assume that she will not respond to yours.  Ebay will automatically side with you in that case.
 
I am also sorry to hear it was a gift for your sister but hopefully she will understand. By the way what pony was it, may I ask?  There maybe someone here who can help you. :)

This is what I would advise as well. You should get your money back and be able to leave some honest appropriate feedback  :hug:  that doesnt stop it from being an upsetting situation though , especially as you bought the pony as a gift :sad:

No you didn't give the name, but the situation (hospital sory) was the same.

I didn't have an answer to my email :(

But i know, she didn't said the name, but the story about the hospital was completely the same (brother of seller sending email, saying seller (his sister) was in hospital).


My chance to open a case has already run out of time. I feel so stupid for not keeping an eye out for that! :sad:
The seller did not respond (yet?) to my email. But i guess there's nothing i can do....


By the way, the pony was a UK Newborn Stargaze. I had her for €10 (including shipping). I just know there will not be a member who could/would sell her so cheap :( i just feel sad.

Oh, isn't there a rule saying that you have to give your real name to Paypal? The name this person is registered with on Paypal is definitely not her real name!

I left a negative now and can you believe that I felt a bit terrible doing this? I really must be stupid!

 It would have been one thing if she tried to rectify the situation but she didn't.  She didn't even attempt to fight the case.  And to me that shows she didn't care to much about her feedback to begin with.

I know it's "just" €10 i lost, but it's the whole thing that makes me sad. That people do this, for example. I emailed her again today, by the way. But i think for me there will not be a solution anymore.
I'm feeling really stupid and dumb about the 45 day limit, i can't shake that feeling off.

I just checked my Paypal account and there was a lot of information about her! I have her real name, e-mail address and a mobile phone number! I can also see that she has given a false name to Paypal which could be used against her, I guess. She had a online shop, too, but it is closed down now.


Maybe you should try this the hard way, send her a SMS, saying that you have her real name and tell her, you will talk to the police if she doesn't send over the pony. And maybe you should report the false name to Paypal.

I did some reserach again. The name she gave to Paypal is the name of her business which was a fashion shop. I also have the postal address of that shop if needed.

The sellers name on Ebay is 'kaoru_deg' and lives in Germany.
Tried to sell me the pony that Naraya bought, but never got. Like i'm gonna buy another pony when the first she sended didn't show up (and Naraya's neither).

I just KNOW the 3rd one will not show up either. The weird thing is that the seller has also some pretty good FB on Ebay.

She basically told hokupokus the same things she said to me: how it was all my fault and how she had sent the pony twice but it had been returned twice because I hadn't picked it up at the post office. Sorry, but she is just a liar!
 
I asked her about some things but never got an answer:
 
- Where is her proof of shipping? I paid for tracked shipping! (Well, she obviously has none!)
- Where are those messages she said she had sent to me? (I had Ebay check my inbox to prove I was saying the truth!)
- Why didn't she answer my messages just until I filed the claim?
- Why didn't she try and work things out with me? Why didn't she ask me about my address?
 
I saw that she has a good reputation on Ebay. My theory is that she maybe really was in hospital and that her brother made some mistakes when sending those parcels. Maybe he wrote the wrong addresses on them or misspelled something. I really would have understood that, but I don't want  to be lied to. I'm a good Ebay buyer myself with lots of good feedback. I wouldn't file a claim just to blame someone. And I really wanted the pony!

I don't think the blame lies anywhere else but on the seller.  I understand that unexpected things come up but you should always have a back up plan.  And by the sounds of it, it should not have been her brother whom she is claiming supposedly sent out these packages.  If you both have checked your mailing address's and they are correct then she screwed up. 
 
I don't know but I would keep those claims open.   There is noway she had two packages, going to different people not show up and get sent back to her.  Then send the same exact messages to those in question.  I'm not buying it.  Plus not answering emails or providing proof of shipment is only adding to her being guilty.

Im also feeling a bit guilty, because the woman is pretty polite, and im confused wether it was scam or honest mistake.

dont feel guilty :hug:  something is definitely amiss here and if she was in the hospital and her brother made mistakes then she should have just been honest. I dont know if I'm buying that story though TBH   :awake:

Don't feel guilty. It is a strange story and I doubt she is honest. Just proceed what you were doing. Afterall you don't have your pony! And the aslo is the strange story of Naraya. Don't feel guilty it is just to fishy!
