Title: Kinder Surprise Eggs...now in the US?
Post by: Mkia on December 04, 2016, 04:48:44 PM
So I was doing a little shopping at our local mall and the candy store had real Kinder eggs!! Not Yowies or any of the off-brand kinder type eggs. These are real Kinder brand! They came at a steep price of $5/egg but I had to get a couple!!

Wonder if this means they're going to be sold here more often? Or perhaps this store is breaking the rules? Lol

I really don't actually care for Kinder chocolate. When I was collecting all the MLP Equestria figures a few months back I always gave the chocolate to my boyfriend lol.
Did the egg have a visible plastic ridge like the new Yowies do? That's how they get around the law, but I've also heard of US stores somehow importing and selling them illegally.
Honestly, I think the toy capsule is the least dangerous part. It's actually designed to be safer to open than old ones (no longer a chocking hazard *rolls eyes* I used to bite them open as a kid and I'm still alive) but the toys inside are still in small pieces that could be choked on instead.

Side note: Modern Yowies are nothing compared to their original design. Being able to put the creature together and have action features was the best part, solid plastic is lame. I'm still so bitter about this lol.

Wow! I've always wanted the neat Kinder Egg toys after I found out about them. I'll have to check the candy store in my mall also.

Nope, just the small yellow capsule inside the chocolate egg. No lip around it like the Yowies have. These are legit Kinder eggs like I remember from when I was young. Not sure if it's legal to sell them, but they were at Fuzziwigs (candy store) in my mall.

At that price they're either still illegal or someone is preying on a law change most of you don't know about. I just checked walmart.ca and I can get a three pack for $3.25 Canadian, which is about $2.40 usd. You're being robbed, I'm afraid. *sigh*

$5?!  Me thinks it was an illegal move on the stores front if its priced that high :(

Congrats though <3  Kinder eggs are pretty special.

Lol it could be. This candy store is notoriously overpriced to begin with. They've always got harder to find candies, so I guess that's how they justify it?

Five dollars??! Yikes! That's what I paid for my Kinder christmas chocolate calendar.. The eggs costs about a fifth of that over here and I think that's too expensive.

I was told it's a $3k fine per egg if you get caught crossing the Canadian boarder with them. mind you I used to go to Costco in Canada and pick up multiple cases to share with friends and family in the US. but at 3k each my kinder egg smuggeling  days are done. sad.

I think they're legal. Even at the crazy price. They've been popping up in candy stores and even chain party stores over here, and $5 has been the price at all of them from what I saw. I THINK it was Party City I saw them at, the others were independent stores. So I wouldn't think a chain store would want to be in on the illegal candy business. At least I hope not!

I like Kinder chocolate, but it is REALLY expensive over here. One of the stores was selling Kinder Santa shaped chocolates, but they were even more than the eggs were.

In high school my German teacher used to get them sent in and we could trade our "marks" for them (and other German goodies).  I have a small plastic safe and a sleepwalking bear that I got as toys out of them.  I found some about 10 years ago (I think it may have been that long ago) at a restaurant in Salt Lake City.  I think it was Tony Roma's.  I didn't realize they were supposed to be illegal in the states.

The import candy store in the mall where I work has had them for a while (2+ years anyway) and I always wondered how they got around the law.  They are pretty pricey at like $4 or so an egg but honestly it's worth it to me because I like the surprise.  The store has had them more often and more of them at a time in the past year or so, though.  When I first started working at the mall, the Kinder Eggs would only be there sometimes, and they would sell out FAST, but now there seems to be a pretty steady supply of them, and both the ones in the red and pink wrappers.

Pretty sure they're still illegal to import, unless the packaging has changed or maybe the law has been amended to where the import tax is higher for liability. I haven't seen any news updates or online buzz about them being legal now.

I think the "Joy" ones are legal since the toy is separate from the chocolate. Sometimes import stores get away with selling things that are technically illegal. The Asian market near me had Furuta chocolate eggs with Pokémon figures inside.

You are super lucky to find those even if they are over priced.  People take risks that I could never take.  If they get caught they are going to be in so much trouble and financially they could really lose their business just in fines alone.  Lets just hope maybe they don't know they are illegal.  They still are.

One of the malls near me also carried them about a year ago. It was at a candy/snack kiosk, right in the front entrance. Not sure if they still have them since I rarely go there.

Gonna agree with this. Now that I thought about it, the only ones I've seen are Kinder Joys. No Kinder Surprise. The ones i see ALL have the outer tab thingy on the side or on the top. Which from what I gather, makes them legal on some sort of technicality, I guess. Weird.

Edit; Or maybe customs just don't care anymore lol. I guess they are still illegal... But I'm seeing them all over lately even though I had never seen a single one before in my life until this year. Watch out for that lawsuit, Party City... Lol. They're probably not selling too well at $5 per egg though.

The rule is that candy can't fully surround a non food item. That's how the Yowwies are allowed to be sold since they have a ridge that is visible. Joys are 100% legal since the candy is in a separate compartment from the toy.

I agree that the legality makes sense to me. But all I'm getting in google results are the typical "yes, kinder joys are still illegal" buuuut, i can't find any dated 2016. They're all 2015 and earlier. I'm still leaning on them being legal too. I just find it hard to believe that something apparently so illegal and high on fines would just be all over the place like they are lately and so suddenly. They just sort of flooded into stores in this area this year. And on top of that... It would be weird for them to be $5 everywhere if they were part of some candy black market lol. That seems like a set retail price. Because of all that, I assumed there was a law change.

Now if they'll just bring the price down... I'm in. :lookround: i'd only pay the $5 if we got the MLP ones. Maybe just once. I haven't had a candy like a Kinder egg since WonderBall was a thing.

Yeah, Kinder Joy is legal, because the toy capsule is clearly visible before eating the chocolate, whereas the Kinder Surprise has the toy capsule completely surrounded, hidden by the chocolate. *shrug*

I also don't know if I can agree with them being "all over the place," personally, since I've yet to see even one, even in import shops and shops with import sections (which we visit pretty frequently, since my mom is an expat). I'll have to keep an eye out in case they start popping up here, though. It's possible California is just more lax than Texas, idk.

I wouldn't spend $5 on one candy, though; that's pretty steep haha, I wouldn't be surprised if they were charging that higher rate to offset not only taxes, but also to help offset fines if they get caught importing banned substance.  :P

Sorry, to clarify, I meant all over in this area of CA. Because I also went to never seeing one in my life to seeing them in like...3 different stores within a short timeframe. Only one of which was an import candy shop(also at a mall like OP.) I think the third was a grocery store or something similar, but I can't recall which one at the moment. I've sort of been brushing past them like "Oh hey, a Kinder egg. Neat." but not really being super interested because of the price and lack of character toy stuff in them. I haven't seen any with characters on them.

It's pretty plausible that we're more lax here too. We do tend to have a lot of imported candy from various places just hanging out in chain grocery stores like Walmart and Safeway here.

But yeah, I agree...$5 for one is a lot. I'm going back to the mall where they have these this weekend...I'm curious to see how much of a ripoff their Kinder Santa chocolate is here. Seems people here could tell me!

Hun, not a good idea if they are illegal there still.  You and the person you send them to can both get in trouble if customs finds out.

Its crazy, I know, but that's how it is at the moment I think.

I love how it says you may unknowing choke on the object.  Do they mean that huge yellow capsule that has the toy inside?  Seriously?  If they're "unknowingly" choking on that, then they must have an enormous mouth.

Ummm think again CustomsRfun.  You can be fined up to 2500 per egg and with customs forms you will be found out.  It is never a good idea to break the law no matter how silly we think the law is.  Think about what you are doing to the person you are sending them to also.  They will be fined as well.  That really isn't a very nice thing to do to someone.  If someone sent me a kinder egg and they were caught I would also pay that fine. I don't have that kind of money at all.  This is not something that I think people should take lightly.

Also regarding the choking.  They have had reports of children choking on these and ending up nearly dying. I have read these reports but it has bee a while.  A child can do anything.  Remember all children are like super heroes.  What they can do to themselves in a short amount of time with an impossible item to have the most improbable outcome is amazing.  Ask er doctors.  They will be the first to tell you.  Big mouth, big nose, everything.  Children will stick something just about any place they like. LOL   They choke, they fly off, they are squashed, they bounce off of things that just should not happen.  In fact to the normal human mind of reason it is impossible, yet the child just did it right before your eyes...or rather in a blink of the eye which for a child is eternity. ^.^

I hope they do become legal. I always thought it was silly beyond the choking hazard.
When I lived in german we would send them back to the us all the time.
Mostly though we bought cases for DnD parties and used the figures in our game. I even have a whole happy hippo star wars set I collected.
I thought I saw them at world market last week. Ill have to go back and look.

This is exactly what I did when they had TsumTsum chocolate eggs here earlier this year, took the capsules out of the egg and sent them to friends.  No issues with that :)

Bad chocolate and a bright yellow plastic capsule in it. In the capsule is a toy that ypu have to build, or a little figurine....

Ive been seeing those, the Pokémon Furuta ones, the cheap hello kitty ones, amd Yowie ALL over the place! I love little tiny toys inside chocolate eggs, glad to see they are making a comeback!

I found these just yesterday at a small international candy store in Frisco, TX! I bought two but these are for the boys Christmas stocking stuffers so I cant open them!  :P they were $8 each but I got too excited and caught up in the moment I caved! xD

YES OMG so true! The short time I lived in MN we would take our passport cards and drive to Canada for some cool non-US treats! We were warned NOT to try to bring them back across the border with the chocolate covering the toy, just open and eat the chocolate before we left but still keep the toy. There is indeed a HUGE fine if you try to bring them back into the US unwrapped with the chocolate surrounding the capsule! The border patrol may actually even search your car which sounds silly but its true!
