I just heared that kinder surprise is forbiden in the USA is it true?

Yes unfortunately. Its illegal to put toys inside candy here, no matter how many small choking hazard warnings it has. Customs claims thousands a year trying to cross the border. You can smuggle them in pony packages though and just claim chocolates or candy are in the box with the pony. We can buy the toys on ebay, I have a ton of them. I really want the whole thing though.

I can always sent some XD I don't care if I get cough XD I used to ship them for a friend didn't know they where forbidden XD I don't put a senders address on any outgoing package anyway XD
but I didn't know they where illegal, they where my favorite candy as a child.

Yeeeaaah, unfortunately. Another example of a reeeeeally stupid, backwards, law we have here. Because Americans don't blame their own negligence for letting their small children choke on something.... They blame the candy company and the store that sells it. *sigh*
But I picked some up once in France, and I had no problem getting them through airport security. I didn't even know they were illegal at the time. :/
You can probably smuggle some through, especially if you're mailing them.

It's true. I was coming back from the Netherlands, and customs saw them in my bag and threw them away.
There's a story floating around about a woman who had to pay a $3,000 fine for having them. Sheesh. How overboard is that?

Yup. Some stupid idiot didn't watch their kids eat chocolate and they choked on the special prize inside, so everyone has to suffer. Even though I had some imported to me as a kid and WONDER UPON WONDER.....

I have a solution - they have to make them about twice the size, that way the egg inside can be far too big to put into any mouth and you get much more chocolate :D Perfect :)

How can you choke on the toy inside the egg? It's inside another plastic container! And it is CLEARLY labeled as such. It is also only for kids 3 and up (I believe that is what is stated on the package). I had no idea these were illegal in the US... first one I ever had was in the US. My dad was a trucker.

Sorry if i´m going off topic, but Nessie isn't the only one, there is actually one such "monster" in Sweden that's protected as well. however, the main reason for their "protection" is that people are obsessing too much over trying to prove they exist and catch them, they are disturbing the lakes. So it's there to stop the people from acting irrationally and harming the ecosystem rather than protect something that isn't there :P

It's not just the fact it's a choking hazard. There were also rules against having toys inside food. Also it didn't meet small parts requirement. It was too small.
The woman was fined 300.00. Not 3000.
I can understand that if the government didn't pay attention to the law they set, they'd be flooded with parents asking them to uphold it.
Of course there's always some that will sneak on by.

Wow, I didn't know they were banned. I used to have them when we went to visit my great-grandfather in Wisconsin. I guess maybe he had some hoarded or sent from Germany or something :/ that's too bad, I used to love them as a kid.

One possibility is of course to crack the eggs open, send the junk in one bag and the chocolates in other. The eggs can be cracked quite nicely open. Of course if it is illegal to import anything that says "Kinder Surprise" then you'd need to repack them too. And if they don't arrive, sue the customs or something.
In other news: Don't dry your cat in a microwave oven. Hot coffee is hot. Sharp things are sharp etc. In some countries it's the manufacturer's fault that some of the users of their products are missing a few screws.

They were actually being sold in the US until Nestle started making their Magic Ball, which was similar. Mars didn't like the competition so they decided to bring it to the government's attention that the Magic Balls (and Kinder eggs got dragged into this as well) were in violation of the law.

Mars didn't like the competition so they decided to bring it to the government's attention that the Magic Balls (and Kinder eggs got dragged into this as well) were in violation of the law.
Actually I heard it was become some idiot kids were swallowing the toys because they popped the whole egg in their mouths and didn't chew.

Yeah. It's all negligence of lazy americans at fault that don't like to take responsibility for being lazy about not monitoring their 2 year old with a egg that has a toy in it.
wtf illegal though... that's like banninating coffee because americans burn themselves on it and sue every company that produces it. (True story from McDonald's!)

I was going through a bunch of old outdated random laws from different coutries one night at work, some of them were a real crack up. This is just insane though, kinder surprise eggs are awesome! I love kinder choccie, you can buy it on its own, but its half the fun finding out what surprise you have inside the egg :P

No, but we do have labels saying that your hot beverage may be hot, your soup may be hot after removing it from the microwave, and that peanuts may contain nuts (which I guess sort of makes sense because peanuts aren't really nuts and someone may be fine with peanuts and allergic to tree nuts, but it sound silly). For a while, they were trying to make hot dogs a different shape (like hamburger shaped) because kids would occasionally choke on one.

My peanuts don't say "May contain nuts" they say "May contain peanuts". I find myself wondering what the heck else is in this package if it's not peanuts.

I wouldn't be surprised if Mars didn't pay some mom to say that. As long as the Heimlich maneuver is done the kid will be alright and not need any medical attention so there isn't really anything to prove it other than someone saying it happened.

Insanity. Just because something could happen (or has happened very rarely in the past) doesn't mean something should be banned.
And I think the hot coffee woman actually was right to sue. Completely. I've heard of TONS of other frivolous lawsuits that tick me off, but that's not one of them. :)

The coffee manual at Mcdonalds required the coffee to be 180 degrees minimum. That temp causes third degree burns in seconds. A 79 year old woman was severely burnt and had to have grafts. It was probably thousands in bills. That's why she sued.

Federal Food, Drug, and Cosmetic Act (FD&C Act) - Sec. 402. [21 USC §342] Adulterated Food
(d) Confectionery containing alcohol or nonnutritive substance. If it is confectionery, and—
(1) has partially or completely imbedded therein any nonnutritive object, except that this subparagraph shall not apply in the case of any nonnutritive object if, in the judgment of the Secretary as provided by regulations, such object is of practical functional value to the confectionery product and would not render the product injurious or hazardous to health;
(2) bears or contains any alcohol other than alcohol not in excess of one-half of 1 per centum by volume derived solely from the use of flavoring extracts, except that this clause shall not apply to confectionery which is introduced or delivered for introduction into, or received or held for sale in, interstate commerce if the sale of such confectionery is permitted under the laws of the State in which such confectionery is intended to be offered for sale; or
(3) bears or contains any nonnutritive substance, except that this subparagraph shall not apply to a safe nonnutritive substance which is in or on confectionery by reason of its use for some practical functional purpose in the manufacture, packaging, or storage of such confectionery if the use of the substance does not promote deception of the consumer or otherwise result in adulteration or misbranding in violation of any provision of this Act, except that the Secretary may, for the purpose of avoiding or resolving uncertainty as to the application of this subparagraph, issue regulations allowing or prohibiting the use of particular nonnutritive substances.
We used to have the Nestle Wonder Ball over here but they got busted too. We don't have a specific law that says "NO KINDER SURPRISE ALLOWED!" But we do have laws about people adulterating food with non-edible objects. That's great when we're trying to avoid razor blades or whatever. Not so great when we want a toy inside our tasty treat!
Like was previously said, Mars called Nestle out and then there was no more Wonder Ball. And no more Kinder Surprise either!

My peanuts don't say "May contain nuts" they say "May contain peanuts". I find myself wondering what the heck else is in this package if it's not peanuts.
If I buy a package of peanuts, I'd kind of hope that it contained peanuts - that's what I bought it for. It's like sleeping pills warnings, "may cause drowsiness".... yeah, that's kinda what I'm hoping for :P

I'm at peace with them not being sold in the US; that's fine. But to not allow an adult to bring them over for herself as a souvenir is just ridiculous. We're such a babysitter state.
Oh well. I just want the toys anyway. I don't even eat the chocolate. I'll start removing the toys from the package BEFORE I come back, hahaha.

*looks at her monkey stamp* We get them from time to time. The chocolate actually brings me back to my childhood. I wasnt really into kinder surprise but the company makes the same type of chocolate into small bars for kids. When I went overseas we would get a few^^

You'd be so surprised at what things that aren't food-based have peanuts in them. And peanut allergy parents are constantly lobbying.
Just like a parent whose kid would swallow a toy would lobby.
If they packaged like they do Easter Bunnies in large boxes with warnings, it'd be great if they could sell them here!

I applaud the valiant efforts of any child who swallows one of their toys, seeing as the toys (at least now) are encased in a plastic eggs themselves, which are extremely hard to get open and roughly the size of a small potato. If they got the egg open, it would be the same as any other toy with small parts, irrelevant of it having been inside a chocolate shell. Should we ban boxes because they may contain small parts inside? lol Apparently German children are not as stupid as they never seem to have a problem.
I hate it when the stupidity/greed of the few ruins everything for the rest of us. THIS IS WHY WE CANT HAVE NICE THINGS!

Nestle started making a candy here called Nestle Magic but the FDA warned them it violated the law. So they hired lobbyists and lawyers to get the law rewritten so we COULD have toys in our candy.
Meanwhile, Mars candy company (M&Ms, Snickers, etc.) was jealous and did their best to kill it. I imagine they made sure "concerned" parent groups knew about it so they would speak against the candy.
Nestle finally gave up. A few years later they made the Wonder Ball but it had candy pieces inside instead of toys.
Nestle tried to make it legal. Mars made it difficult for them. On paper Mars would probably say they were looking out for children, but you know it was probably just them having a go at the competition.
In other news, I've received several boxes of Kinder Surprise in the mail without a problem. I haven't been that impressed with the toys. I want the cute little plastic figures but they only seem to have one per 3 pack. I always end up with these stupid spinning top things or gliders. I did get a really cute little car, though!

The only way I can get them is through a friend from Germany; he sends us a big box of candy every year. It's difficult to get them through customs, but if you mail them nobody checks. I live pretty close to Canada though, I wonder if they sell them there?

Well, a lot of parts of that law were important (such as requiring testing before selling drugs, etc). With the 1906 law, if people died because of a product, they gave you a fine and just assumed the damaged reputation of your company would be punishment enough.

Oman, I get these every Easter! LOVE THEM! But, I can see how a kid could choke. If they bit right into it, the pressure of their teeth could hit the crease of the plastic eg inside, causing it to break open and a small piece could potentially fall down their throat. BUT, it's up to the parents to monitor their children with something like that. I understand the precaution, but at the same time I think it's stupid.
PLUS, kinder choclate is the best chocolate. MMMMMM. I'll be thinking of this with the next swap package I send.

xkelpiex, there's been years since I have a Kinder Surprise, but as far as I remember, the plastic egg was hard as... and not an easy task to open/break it.
I bit down on it trying to open it, and at the end just decided to go the easy (¿?) way and help opening it with a butter knife o.o
I admit it, I never was a fan of this chocolate (not even chocolates in general *shudders*), and less because the toys need to be put together and got desperate at them =P But the tv commercials showing the different collections were really cool =)

I kind of wonder if this isn't the same reason Cracker Jack has really pointless prizes now.
Apparently back in the day you could get rings and stuff. I think I remember getting a miniature magic drawing pad once? (You know, the pad with the pink plastic and you magically erase it when you lift the pages).
Then about 10-15 years ago I remember getting prizes like plastic holographic Wishbone dog tags.
Now you get a little paper leaflet with like a joke and a piece of paper to "decorate" your pencil with. Lame.

I do kind of understand what they're getting at with those. They must have had some incidents of small children choking on those little toys in order to justify it. We do like to copy you guys over here so I'm sure they'll be gone from our shelves soon too. Which is a shame because they were a staple part of my diet when I was a kid...

I don't even like them that much, they're too sweet for my taste, but suddenly I feel the craving for one, lol.
The plastic egg is the best part of the hole thing though.. Put in some baking soda, add a little water, put it together quickly, shake and throw. Kabam!!! I had so much fun with that as a kid ^___^. Or just put a little doggietreat inside and give it to the dog. I also used some of them to store my dried herbs. So much useful things of that little egg.

I think it's a silly law! It's one of the biggest import chocolate sales in SA! And all the stuff inside... I had the whole collection of Astrix & Obelix and pets the had a few years back.

Weird! I remember getting an off brand version of something like this from Big Lots last year during Easter time. It is silly that something must be banned because some people did not use common sense and got hurt.
Reminds me of these posters that we have at work that say "Knives will cut" in huge letters.

I'd never heard of them before I saw this topic, but they remind me of those Nestle Magic Balls that I used to buy all the time back in the 90s. I loved the little Disney figures they had in them. My favorite one was Princess Jasmine. Once they stopped making them, I remember going into the store and finding them all for a quarter each, so I ended up buying a full case of them. I have no idea what happened to them, but I wish I still had a few of the little toys.

i was trying to order a whole box of them online once. we had something similar just 2 years ago at easter time. it was a chocolate egg, that inside was a hard plastic egg shell that you had to open, and inside that was a toy. i never saw them for sale again so my guess is that they outlawed them. the chocolate was AMAZING though. so i went online to try to find something similar and saw the kinder eggs, i tried to order a whole box but wasn't allowed since i'm in the US. its not fair :(
there are plenty of other things that children are more likely to choke on than a toy inside candy. i bet that's why we only get stickers inside cracker jacks now.

Man I remember when the Wonder Ball's had toys inside. I still have a toy from it, wonder if it's worth anything.

as for suing for ridiculous reasons, the Weird Al Yankovic song I'll Sue Ya pretty much sums it up. It's a whole song of worthless lawsuits. xDD
The US is full of sue happy people and idiots. Ever watch those court shows? "My kid was playing with my grandkid and they broke our tv by pushing too many buttons on the remote, so I'm suing my daughter!"

Heh, that's so weird! I used to love them as a child! (As a matter of fact, I still do!)
I visited Florida in 2009, and they sold them there, at an imported goods store at a mall.

Prizes because one, it's cheaper, two, they had brand loyalty for years and years from consumers + a good product. People would still buy them.

I always read that they're illegal in the US, but I've bought them. I spot them sometimes at different import stores. I don't really enjoy the chocolate or need the toys, so they're not something I keep an eye out for, but I have purchased them in the past.

OMG WTHay!!! I had no idea they where illegal and I once send some in a swap box for an American swap partner. Good thing they went through customs. Being from Europe I already find USA weird, but they still manage to surprise me, amuse me and make me roll my eyes XD

Out of curiosity (yeah, never had a Kinder Surprise egg before), especially after seeing an Ashens review on it, I bought one yesterday just to see what all the fuss was about.
I think the Malaysian version of the egg would be much more acceptable in the US. It's shell splits neatly in half, with one half of the shelf having the chocolate, and the other half having the toy. Both halves are separated by a pair of plastic seals.
Also, I just noticed: for some reason, the egg is called a Kinder Joy egg over here.

Do you know in Scotland it is "illegal to be drunk and in charge of a cow"?
That's really funny, here in Minnesota, the only things that are legal to ride when intoxicated are a non-motorized vehicle like a bicycle, or a horse because it can steer itself.
We did have chocolate balls filled with prizes when I was little. Usually little tart candies but I think sometimes it was other things too. They were called Wonderballs. I guess the aforementioned risk of choking got them banned.
