Hi pony peeps
 
I'm going to keep this brief as I just typed it all out and then lost what I'd written!
 
Has anyone else bought from diaphonealoe on ebay and had problems?
 
I bought a Taobao variant who didn't arrive after 30 days so contacted her. She was polite and advised the date sent and then emailed me a few days later to ask if she'd arrived. I advised not and that I was growing concerned. She said she'd send another one and had done this before receiving my request for a refund instead of another pony, as in the meantime she'd received negative feedback for situations similar to mine.
 
Now my PayPal deadline is here so I've filed a dispute to which she replied implying I was lieing. This given the negative feedback lead me to escalate the dispute to a claim.
 
She then sent the following messgae:
 
"URGENT PLEASE READ:
Due to not being able to pay ebay fees because of
the case, I'm requesting that you cancel it. Princess Celestia has been
sent out but I am unable to provide tracking overseas. This brings up
another issue, since this case is being held over international waters,
it's very nervous. If the case is closed and you do not receive your item
in 3 to 4 weeks, you can happily open it up again. However because this
case is open I'm unable to pay fees, bills, and other things as well. I
REALLY would appreciate it if you would wait. I understand because I myself
have ordered things international and they take quite some time. PLEASE
bare with me and be patient."
 
My response to this:
 
"I am sorry for your situation but you also have responsibilities as a seller which need to be met. If I close the case I cannot reopen it in 3 weeks because PayPal has deadlines and that deadline is in the next couple of days so that would leave me without buyer protection.
In the case of items lost in the post then you need to claim the money back from your post office. It is unfair to ask your buyers to do what you are asking. I have already waited more than a reasonable length of time for the ponies to arrive.
While ever I sympathise with your situation I cannot close the case and lose the protection I currently have through PayPal for this large sum if money that currently I have nothing to show for."
 
She now appears to be trying to guilt me into cancelling my claim and I would be left without buyer protection if I did what she said.
 
If the pony arrives and she's refunded me I will repay her, I'm not out to rob her, I just want my money back for goods I haven't received.
 
I just wondered if anyone else had any similar experiences, or indeed any good experiences to ease my mind about the whereabouts of this pony?

If I am right - when you close a claim with PayPal, you can't open it again? So do not close that claim.


EDIT - also this is probably better off in Trader Support, gonna poke a mod to move it

I hope you get your items.. please update us in the Trader Support forum if you don't, or if she begins to harass you.

It is understandable why she might be upset at the Paypal claim, but as your response read, that isn't your problem as a buyer.  If she can't go without the money for the time it takes the package to reach you, she really has no business selling.  :(  Taking on shipping risks and costs is part of the benefit to selling in an international market.  She should understand that you only have 45 days to open a claim and that the mail could take even longer than that.  That was HER decision to sell internationally!  ;)

Urg, where did I put it?! I meant to put it in TS! I was having a stressful few minutes though so apologies for that!

Oh don't worry there's no way I'm closing it and I think you're right that you can't re-open it once it's closed. I was just wondering what experiences, if any, anyone else had, and wanted to give people a heads up with the info I have about her

Do not close the case, it is true that once the claim is closed you can not reopen it.  And do not let her guilt you into thinking so by saying she needs to pay her ebay fee's, they are not due until the 15th of each month unless she is behind.  :(   Plus she has 20 days to prove she shipped it or that the item arrives to you and you can close the dispute.   
 
I can say though that International mail is at it's slowest that I have ever seen in all my years on ebay.  I have packages going to the UK, Germany and Australia taking twice as long as before.  And that's at the 45+ mark.  And although this maybe the case you were within your rights to open the claim considering her feedback is reflecting that she is having issues with being out of stock and items not received.
 
I would email her back and explain that as soon as the item arrives the dispute will be closed, otherwise you feel it is in your best interest to keep the case open till the issue is resolved.

While I didn't have a problem, my transaction with her didn't inspire confidence. I bought an international exclusive, which was one of two available. It was never marked as being shipped, but it arrived fairly quickly. Then I received an email from her apologizing for the delay in shipment; she would send it right away. I told her not to ship to me, as I had already received my item. She had mixed up the orders, so I assume the other buyer waited a while for her package.


Hopefully, your package will show up, but leaving the case open in the meantime sounds like a good idea. It sounds like you have a good reason to be cautious.

I absolutely had a problem with this seller, and I would strongly recommend not buying from her.  Do not close your case.  She did ship my items, but only AFTER I had to open a case on her.

I have been extremely leery of this seller ever since...

Oh noes what a pain for you! I hate when sellers try the guilt trip thing  :(    TBH if other people are having problems now and there have been issues in the past, I would be very wary of dealing with this seller. Dont let her make you feel bad, and do not close the case whatever she says cos as the others already said, you cant re-open it and you stand a very good chance of losing your monies :yikes:  International mail is very slow right now so you might still get your pony, but dont take any risks ;)

Sorry to hear other people have had problems too, I thought it might be the case as she seems to have had quite a few variants and stuff for sale lately which would obviously attract the attention of our comminity.

I've had some information from outside the arena about a problem transaction too :/ So I'm now of the mind that my pony isn't going to arrive :( I hope she does though.... I'd prefer the pony to a refund! Though at least with a PayPal claim open I will get a refund if she doesn't show up as the seller has already told me she doesn't have a tracking number.

But why does she not have a Customs Number for you?  Although it does not track the package it will itleast show that is was accepted at the PO.  It would help her dispute and also give you a piece of mind?

  This!! Or scans of the shipping receipt at the very least! If she shipped we all know that she should have a receipt. XD

Nope, she's not given me anything, I really believe she hasn't shipped to be honest. I'll keep you updated. At the moment she says she'll refund me when she has the money, but PayPal require her response by 8th March and if she hasn't responded then they'll make a decision. Based on past experience they should send me the refund and collect the money back from her if she can't prove she's shipped it.

Well, no pony but PayPal issued a refund yesterday so at least I got my money back.

What should I do about feedback do you think? Sometimes I feel like just leaving none because it's easier but I don't want other collectors, especially those here, to get ripped off :/

I don't think I could leave negative because she was pleasant the whole way through except that one tiny comment implying I was lieing (she put 'supposedly' in brackets when referring to the fact that I hadn't received the pony) so could leave neutral saying that I had to get a refund because the pony didn't arrive? Or am I being too nice?? :P

I don't believe in leaving negatives lightly, but she tried to decieve you in asking to close the pp case & re - open it, which you can't actually do, then she would have her money and you would still have no item.

She claims she sent you one, which didn't arrive, then sent another, that also didn't arrive. She did not offer you a refund, wanted you to cough up the $ and have no item to show for it. I personally think she deserves a neg, you can give a polite response to the negative though, something along the lines of "never recieved item, had to open paypal dispute for refund"

Definitely leave her some feedback  to warn other about potential problems when dealing with her ;)  If you dont feel like giving her a neg , then go with the neutral and comments about the pony not arriving so you got a refund.

Ordinarily I think after reading 'Paints and Lovesbabysquirmy's comments I would have thought yeah this deserves a neg... but it's something she said yesterday... I'm struggling how to phrase this without sounding offensive... um, I think she has a lack of understanding of things and gets easily confused.

Basically she sent me a message asking me to 'hold up my end of the deal' now PayPal have refunded and send her the payment for the pony. My response was "What?! I said I would repay if I received a pony but I have not" and she sent a very genuine sounding apology saying she got confused and didn't realise I hadn't received her.

So this could be a ruse but the whole case through PayPal was about a pony who didn't arrive so should have been obvious and I just don't think anyone would make themselves look that daft on purpose... I think something's going on with her where she gets confused.

So I can't bring myself to leave negative as this seems quite a possibility from reading her messages. I'll leave neutral though so that others are aware of what happened.

I feel I may be overthinking this but I have this affliction where I need to give people the benefit of the doubt, sometimes even past when they actually deserve it :P

Honestly, as a buyer, I would want this sort of situation to have a negative feedback so I would know to stay away. Regardless of her personal problems, she has no business selling if she can't keep the orders straight and is messing up this badly, and if she wants to sell on eBay she should be held to the same standard as everyone else. Leaving a negative feedback isn't a judgment of her personal character, it's a judgment of her bad business practices. From the sounds of it, she was deficient in all areas: poor communication, no evidence of shipping the item, guilt-tripped you over her own finances, and tried to get you to close a legitimate case against her whilst giving you false information about the ability to re-open it. Whether she was out to intentionally fleece you or not doesn't really matter. If she gets enough negative feedback, maybe she'll get the message and stop selling, so that no more buyers have to deal with her.

I do understand what you are saying, but agree with babystarz, she still didn't do the right thing by you.

I don't think it's a personal attack on them, but seriously if they sent two of the same item, at the very least one should have arrived by now. I think they are trying to play you for a fool myself.

She seems really disorganized. I bought my daughter an apple bloom a month or so ago. It took a very long time and I messaged her about it. I wasn't overly worried because it was cheap but still...wanted the pony. She messaged back a few days later and said it had been shipped. I received it shortly thereafter. I told her it arrived and that my daughter loved it. She responded saying she was glad it arrived and so forth. Then, about a week later, I got a message from her asking if I had received Apple Bloom. Very strange...so I think she is a slow shipper and disorganized with her auctions in general.

If it is anything like shipping from our college mail room they dont give you anything.  They only take cash and dont have customs forms. when i do fill out a customs form they dont know what to do with it and toss it. I dont know how anything made it anywhere.  They also dont give receipts.  apparently that's not odd. O_o  I dont use them anymore.

I dont know about the feedback.  You could say negative, but say she was polite.... but i really would be in the same mindset as you.

Jan 21st - Bought an item from diaphonealoe and paid right away

Feb 3rd - (2 weeks later) Saw she had some issues with her feedback, so I asked if she had sent my pony yet and if she had tracking information, or if there was a delay, could she please let me know.   She apologized and said a bunch of shipments got lost in the mail and her post office isn't cooperating. She said my pony will be shipped the following Monday (in 3 days) with tracking and she'd let me know. 
 
Feb 8 - No word from the seller, so I asked again if she had shipped it and gave her some alternate shipping suggestions.   She responded and apologized again. She did ship my pony but "no tracking due to the post office".  Not sure what that means? She apologized again and thanked me for the suggestions.
 
Feb 9 - My pony arrives!  She indeed was sent earlier that week.  I thanked the seller and she thanked me for being helpful and patient through the whole process.
 
I'm usually pretty forgiving if the seller is good about responding and has a good attitude so I gave her positive feedback.
 
I just won another item, but she quickly sent me a message asking me to hold off paying because she may need to cancel this transaction  :(   I'm assuming someone didn't get their item again and she may need to use mine as a replacement.  I'm not happy about that, but at least she gave me warning before money was exchanged.  I'm hoping it works out.
 
In my experience, she sounded genuine. I don't know what sort of issues she's having at her post office and whether it's her fault (or ignorance) or whether something corrupt is happening there.  That's an aweful lot of missing packages!  In your case, if it were me and she was mostly pleasant about it all, I would probably leave a "neutral", saying item never arrived & got a refund by opening a claim.  Maybe add something about the seller being friendly?  I don't know.  It's a tough call. But I don't think anyone can blame you for leaving something harsher to warn others.

Yeah I'm inclined to agree with you all about feedback especially after the message I received today:

"Hi, I was wondering what the deal is with paypal. Why did they refund you
completely? Not only did they refund you the 107 dollars, but gave you an
extra 12.75 (bitta luck). I'm afraid you've gone off and run out with my
money, which I'm already struggling on.."

I didn't mention Bitta Luck before because she was inexpensive compared to the Celestia variant I was concerned about, but I also bought her initially. When she sent the replacement Celestia she said she didn't have another Bitta Luck so she would refund me for her and then send another Celestia. I never received a refund! So when PayPal refunded me they sent me the whole lot back! And now I'm being accused of being a thief. Nice.

I haven't replied yet, I will do today and then block her! I'm fed up of her contacting me with these stupid comments now.

And will be leaving negative feedback.

I fail to see her point that your a thief.  :tellme:   If you did not receive Bitta Luck then you were intitled to a refund for her.  Plain and Simple!
 
I also agree that a negative at this point is warrented for this transaction.  I am not one to usually go that route.  But how many missing ponies can this women have?  I think until she gets it together that she should not be offering up these prototypes that are in demand and will sell.
 
It makes me wonder though if this women lists these ponies without actually having them in hand yet.  And by saying that I mean that she may have her order in to Taoboa and they are on their way, prompting the slow shipping and mixups.

ponylady, she offered a refund for Bitta Luck but didn't send it... I think she thinks she's sent it!

I'm going to reply to her, leave my feedback and then block her as I don't want to keep getting these messages, I just want to put this stupid nonesense with her to bed!
 
EDIT: so it turns out it's too late to leave feedback! What a stupid rule on ebay! If a transaction takes a long time to resolve you can't reflect that in the feedback! How stupid! :throw:

I know right?! As if there should be a deadline! If something's still ongoing you don't want to leave feedback as it might affect you getting your refund/pony/whatever, so you have to wait... stupid ebay :throw:

Does eBay ever extend the feedback deadline due to extenuating circumstances like this? It seems really unfair that because you gave this seller a chance to make things right, you now don't get to leave honest feedback.

I have not dealt with diaphonealoe, but I do have what I think is a bit of interesting information. I've been stalking her white Celestia auctions since they first began appearing and know she has listed at least 7 of them over the past couple months. However, she has only received feedback from 2 of them. I find it hard to believe that 5 of them were sent internationally and/or got lost in the mail. So something screwy definitely seems to be going on...  I was wondering how the heck she got ahold of so many of them, now I'm inclined to think she probably DIDN'T.

Of course, perhaps not everyone will leave feedback (and I saw that you were unable to, Sarah-bee), but still you'd think if everyone had received their pony the percentage would be higher than 2/7+

So I typed this sellers name on the search engine and this post appears.  I ordered an Apple Bloom from this seller and have not received it after 2 weeks. I saw her feedback so I messaged her a few days ago about whether the pony was shipped since it was not marked as shipped. In her description she also says she ships within two days of receiving payment. I paid immediately. I saw she relisted my item and I sent her another message today stating I have not received mine yet. Still no answer from her.  Have I waited long enough? When should you I report her? After three unanswered messages? I don't wan't to be too harsh but from what I've read here sounds like I'll end up having to open a case too :cry:

:( I'm sorry to hear that mshesha  :sad:  Normally I would say to wait for about 4 weeks before opening a case , but with this persons track record of not shipping,  and poor communication, I think I would advise you to open a case if you havent received your parcel by the beginning of next week :awake:

I've been watching her items but have not bid on her items since her feedback has been going down. Her auctions end at high prices so that coupled with her feedback have steered me away.

me too ren-ren, i have been watching her sales with interest and wondering how and were she was getting the ponies. i also noticed that the picture is the same for each sale. things don't quite fit for me.

i did bid on two of her white celestia's at different times and i am glad i got outbid!

Sounds like she ended the auction early, due to "interference".  Unfortunately although it's against Ebay TOS there are some exceptions to the rules that sellers often exploit.

Ren's right!  I understand there can be postal delays but it's not very common in the US for anything to take over a week. 

I am sticking with my theory that she does not have these ponies in hand.  She may have them ordered from Taoboa but anyone who has ordered from there knows the process can take up to a month. 

Mshesha I would open a claim considering this seller's track record.  It can always be closed once it arrives.

NO post office is as "unreliable" as hers seems to be... I hope you get your pony, though...

If you are close to your 45 day deadline I would file a case despite what she says and drop it later if hte pony arrives
Ren's right!  I understand there can be postal delays but it's not very common in the US for anything to take over a week.

EDIT: Just to bring some closure: She did send the pony, and I received it shortly after that.

I paid A LOT of money for one of her ponies and didn't receive it for a month. Post marked a month after I paid, so it wasn't as though it was lost somewhere in the mail, it was just she never bothered to send it. I never complained in that time because I am far too shy, basically. When I got my pony, she was beautiful and well packed, but unfortunately due to the long wait I wouldn't use this seller again. :(
