On Jun 3rd I won a lot from them. I emailed them the next day to let them know I was having a problem paying with paypal because I was trying to use a gift card thingy for $10 off a purchase of $100 or more. It wouldn't go through. On the 6th they opened a UPI and I decided to just pay without out the credit. I was just looking at the lot now, admiring all the goodies coming my way and surfed through their other auctions and found that they sold the lot I won on the same day I paid! They haven't emailed me yet- I'm seriously goting to be upset if they sold it to someone else! :( I'm going to wait until Monday and ask if they have shipped it yet. Seriously ><

Well, I decided to try paypal one more time and they reversed the charges so I got my money back. I'm just glad this is over.

I always pay my BINs right away, but you even messaged her your reason for not being able to pay right away. Even with a BIN, I would give someone a couple days to pay. Especially if they contacted me.
Ponylady, this sucks on your end as well!

Well, this is an unfortunate situation for both of you. :huh: I looked at the seller's feedback, and they have no feedback from selling. I am guessing that this is what happened: they set their Unpaid Item Assistant tool to open a case after 48 hours (I don't think you can manually open a case before 4 days, unless this recently changed). Being a new seller, they must not have realized that they need to wait until the unpaid case is closed in their favor before relisting the auction. I'm not saying that this makes anything right, just trying to piece together what probably happened on the seller's end. *If* that is what happened, it could be lack of selling experience rather than maliciously trying to resell their lot twice.
Please let us know what happens here.

That's really unfair. Personally, I feel that if it were me selling this lot, the person who bought it first should be allowed to buy it, I know it's not fair for either party, but this is a huge seller fault, and they need to sort it. I'm really sorry to both of you involved, that REALLY stinks!

That is fair enough to say but I have $160 dollars wrapped up in it as of now. If it was relisted for slow pay then it is the seller's decision on what they want to do. I know I personally state in my listings that if payment is not made in seven days a case will be opened and item relisted.
Did the seller refund your payment CA? or is he sitting on both our monies???

Oh gosh :( That's really bad. If he has both of your monies, then that's really awful! The seller has definitely messed up. I don't know what I'd do then! But he should have had the decency to contact both of you!

The thing I do not get is that with him being new at selling, Paypal will most likely hold those funds up to 21 days until he has proof of shipping. So he may not even have access to it.
All I know is someone better be getting their money back soon cause it doesn't make me a happy camper to have money tied up. :huh:

I'm not surprised! That's ridiculous that two people don't have their money now :( I hope it all works out! Maybe you guys could work a split out, make it fairer? :)

Actually the rule is they can't get their funds until the items are delivered. Feedback is not required. I am not sure why they didn't contact you and ask you what your intent was before doing this Closet. After looking through what other people have said it may be totally true that they can't refund you because they don't have the funds yet and won't until its delivered, but most likely they shipped it to Ponylady. Oh what a mess. :huh:

Trying to decipher this:
Seller has two lots of money.
Possibly cannot refund due to inability to access it as a new seller.
Once item arrives somewhere, *one* lot of money is made available.
Other lot of money ????

He does have the ability as far as I know to refund "one" of the buyers. He just can't withdraw it or spend it elsewhere.
I think the best course of action at this point is to open a case against him. I nor CA have any confirmation of shipping or emails from him regarding the matter. I am not sure what he is up to :mad:

I did send off a polite email yesterday stating that I noticed that he had resold the lot and inquired as to what he planned to do. No response yet. :/

No. On the forth I sent him a message letting him know paypal wasn't accepting my gift card, but he never responded. I was on the phone with paypal for about three hours the next day and they seemed to have no idea why it wasn't working. Then he filed the UPI on the 6th, so I just paid without using the card.

I am concerned about this seller's intentions especially since there is no communication at all. Something odd is going on with them.

I would just go ahead an open a case at this point to get your money back. Don't bother waiting for this seller.

Oh my goodness! what a rotten situation! :whoa: I'm so sorry for both of you! :( This seller does sound like he is up to something dodgy! two sales of the same lot, two lots of money, and no communication let alone an attempt to sort out the mess of having two different buyers pay for the same item! Makes me feel so angry :mad:

Urgh. How disgraceful that they haven't even bothered to email you. Will be blocking them from my eBay. That's rude.

EBay probably won't do anything about it but I would report them if I were you and leave them appropriate feedback. Their lack of communication and the fact they put the lot back up for sale without giving you the time it takes to go through the NPB case is despicable. EBay really needs to be involved in this instance. This seller has no idea what they are doing.

I'm considering neg feedback only because they refuse to respond to any of my emails- that isn't how you do business, imo. If they would have replied explaining they didn't understand how the process worked, ect then I probably would have let it go, but they didn't respond until I finally filed a case yesterday. IDK, it's just aggravating all around.

I still don't have my refund. Paypal says it would clear by the 17th, but nothing yet. I seriously hope it clears. $160 is a lot to have tied up XD

Yes it was relisted and sold to you because the first buyer took to long to pay so a case was opened and I relisted it. The other buyer has already been taken care of so the lot will be shipped to you. I am sorry for the delay in response but my 3 yr old was sick so needless to say its been a hectic last few days. The lot will be shipped to you tomorrow.

my kid was sick excuse... bleh. i hate when sellers say things like that. dude it isnt hard to write a message on the internet. even if your kid is sick. i communicate pretty fast with my buyers and im busy too. i really do not like their wjole relist policy. they didnt give the other a buyer a chance

Ditto to hating that response. It's a cop out. Generally, when kids are sick, they sleep a lot more than usual. Sooo while you do have to deal with them not feeling good and such, there is plenty of time to get on and write a message to your buyer.

This is just a thought but is it because the account you bought under only has 7 feedback? Thus when she refunded you, Paypal is looking it as you are a new account holder. And holding your funds?
I would probably call Paypal at this point and see why?

Alternate theory: she had no funds in her PayPal to refund with so it tried to transfer from her bank, thus the normal long hold, but then she had no money so it's an even longer hold while they keep trying to get money from her bank account?

The reason I pointed that out was for the fact that the girl actually refunded my money. It showed up in my account immediately. She messaged me and I resent payment back through ebay.
The girl only has 22 feedback and she has not sold or did any buying for the last year or so. Thus Paypal putting limitations on her account. She would not be able to with draw any money that CA or I paid her. She would be able to refund though. But since CA's account is new they will.

I just got off the phone and they said they are waiting for the money to be transfered from the seller's bank, they still haven't gotten it yet and it's possible there is no money in their bank.

It's an absolute ridiculous situation to be honest and I would like it to be over with. I honestly have not had a bad transaction on ebay, buying wise, ever. So I guess there is always a first.

Honestly, I put half the blame on paypal, lol. I had told the paypal rep what had happened and why payment was delayed and he was like yeah, we know we are having issues with the gift cards, so ugh. I just hope it clears soon.

I just got an email from paypal.
An eCheck payment from (Name removed) was declined by the sender's bank. We will automatically try to process this payment again in 3 business days. It then usually takes 3-5 days for the money to be deposited into your account. Please do not ship items until you receive payment.
Really. I think I may pull their contact info tomorrow and give them a call. This is getting rediculous.

Yeah, they spent about $70 June 14th on tablet stuff. I sent a friend request on fb and am going to phone them when I get home. I'm really starting to get angry now.

I understand that we are both highly annoyed at this point. But you have to really watch about contacting them through personal means such as FB. I only wanted to show you that she had a garage sale listed, advertising those ponies.
We have handled it the best we can and it is now in Paypal's hands to handle the situation. Which I have no doubt in my mind that we will get our money back.

Well paypal's 2nd attempt to refund the money from their bank has failed. They are telling me to contact the seller to try and get my money. I'll be getting on the phone with them soon- I'm considering just going through my bank- this has dragged on long enough.

I should have known she was up to something though when she said "Oh I accidently refunded you." Which she did and it went through. But me like a chump resent payment because she said it was an accident. I should have taken my money and ran at that point. :mad:
