Well.. that's a rough situation. Your seller wasn't playing fair either as regards hidden flaws  (the camera did not show anything too bad in the auction pics and the description certainly didn't mention them. He's not near mint of course)and then refusing a refund/return. She had to accept a refund/return because of ebay and ebay will almost certainly side with you and make her refund you/accept a return. However she wasn't willing to work with you until she knew she *had* to.
To me that at least deserves a neutral with stars dinged and some honest comments about hidden flaws. It may well deserve a negative since yes you got a refund but she didn't want to do it- it was only because she had to.
I'm sorry you had to go through all that though , its really disappointing when something isn't described properly, especially as it was something special that you treated yourself with and thought was in much better condition - you even checked with the seller first *sigh*

Well... she got Tex back today, initiated my refund... and immediately relisted him. She still has him listed as "Near Mint," and as "perfect for the collector." Wow. I hope no one else falls for it.

I'm glad you got your refund. It's not OK that she is still listing him as NM though!  Did you give her bad feedback (hopefully people will check it). Is there a way of reporting the listing as misleading?

I haven't left feedback yet since my refund is pending in paypal... thought I should probably wait until it is official.

I wish there was a way to report the item... I wouldn't know, I'm definitely no ebay expert.

I'm glad you got your refund and you should definitely make some mention of him not being as described in your feedback - that way people will hopefully check   but @ her for still listing him as NM !

The seller is being defensive. You are being perfectly reasonable in asking for a refund. This is not near mint. You're not responsible for her reaction. Don't feel guilty xxx

Honestly.....I had to reaaallly squint at your pictures to see those flaws, the little dots on his face would be so easy to miss in a photo- yours is up close and focused on them. He has a dirty belly, and a spot on his butt but he's so gorgeous I would totally buy him if I didn't already have Tex.

He actually has orangeish/pinkish highlighter like marks on one leg too, which was really hard to photograph. He really shouldn't be listed as near mint, not with how many issues he had...

I certainly didn't see anything too bad in the auction pictures, the light and blur hides his flaws well.

Bump. Refund has not come through. It shows as canceled today... I'm guessing because she uses her bank as her source of funding and she didn't have the money in there to cover it!!! I contacted ebay about this... I really hope I get my money back. Beware of this seller, everyone!

Don't worry - ebay will cover you even if she has not.  Definitely follow-up!

I would have given her more credit for making an honest mistake if she hadn't immediately relisted the pony with the same crap photos and no description of the significant flaws which do not appear very well in her crap photos.

Oh you must be so p***ed right now. I agree that this needs to be taken all the way, if she can have your legitimate negative removed and then send you unpleasant messages, I bet she does that kind of thing all the time. What a horrid person!
