Sorry Closet, I know thats a horror to deal with.  I think people just don't see how opening a case too soon can cause such problems.  I am sorry you are dealing with having to borrow to ship out your stuff.  I have been there myself. blaaaaa

Oh goodness...yes I have to agree if you are not happy return it to Closet, to just go back and forth isn't really going to make this situation any better.  Keep in mind that in the future if you need to return something its a good idea not to alter it in any way..and don't take it out of the box to clean it if you plan on returning it because that makes it non refundable.  I feel its a resonable request that she had to see pictures of the damage so she could see what you are talking about. I have bought items from Closet before and she is nice and easy to work with.  Its just that we all can't be at our computers every hour, so its good to give people a day or two to respond. ;)  And in all fairness to Closet as I have mentioned before G4 MIB MOC are noted for having greasy issues, all of the ones I bought did. I quit buying the line because its cheap and not done well.  This can't be Closet's fault...it most likely will be factory and most of us that were into G4 at some point know this.  New or not...its just a fact with the G4 line.  If you don't see a picture you want to see ask a seller before you bid to send you one. I do it all of the time.
she did receive 2 emails from me in eBay with pictures . Before i opened the case

Well I'm a little fuzzy on the details. It sounded like Closet had responded within hours to the initial emailing before a case was opened. I'm just curious why a case was opened if that's the case? If you had sent more emails to her back then it sounds like you guys were in conversation. I just think that if a conversation is still going about what to do a case shouldn't be opened yet. Even if you are in the right (which of course I don't know one way or another).

In any case, many times, I hear many complaints about items having so and so flaw. I have learned from being on many forums that you can't take those accounts at face value. Many buyers don't figure in the factory flaws etc. As someone whose bought a few G4s, I've noticed lots and lots of flaws with them. Actually, the crappy quality is why I'm not too into them.

Judging from the two descriptions, it's hard not to think that closet's assumptions are correct. That there was residue of a sticker, a plastic smell and perhaps some kind of factory "dew" that caused the issues with the box and pony.

I also think that closet is being fair with the return for the full refund. I mean, there's not much else she can do and I don't know if these flaws are something a seller should really be looking out for or if it's even possible considering you would need to have them opened to notice them it sounds. But maybe I'm wrong.

I just started collecting them last july , i guess i'm still new to the whole ebay stuff and what i'm supposed to ask ! I knew i had to pay more for this one and i'm ok with that but I did not know if they sell it as new i could get something like what i got ;( and i know it looks perfect on the pic , that's why i bought it and paid the asking. 115 price !

. I have not opened the toy itself ! I won't open it , the toy case is intact , i wiped it off with a clorox wipe , the plastic pack had a small brake but nothing else ,it was perfect after that and all good until i sense the smell , i know the box it came in had a smell but took it outside and i just checked it and it still has the smell and the toy too

I responded on Oct-04-12 04:24 PM (at this time I logged off and went to relax before heading to bed)

He then sent three other messages on Oct-04-12 04:39 PM, Oct-04-12 04:46 PM and Oct-05-12 11:40 AM.
During those times I was logged off, I went to bed early, then went to work the next morning. I came home, went to doctor had dinner.

The case was filed on Oct-05-12 08:53 PM
Hardly 24 hours later. I didn't see it until 10 pm or so when I checked my ebay stuff.

The whole thing really rubs me the wrong way and I stand by my beliefs that he was just fishing for a partial which he never mentioned untill he opened the case wanted %40 back. I mean, if the smell was so bad, why would you take a pic of it next to your collection? IDK, I'm really to hang up Ebay all together.

i took the pic after unpacking and while taking the pics , is when i sensed the smell , if 40 is too much for you , how much do you think is fair to be refunded ??

If she is not willing to the partial then the pony needs to be returned.  Ebay will not force her to give you a partial but they will make you send it back with tracking.  And upon it's return to her, as in the tracking number shows it was delivered ebay will then issue a refund.

I will keep it so you can have the money ,my intention was for you to make it right but I give up.
but I will have to be honest on my feedback on ebay and It will be  negative :(

Yes I have closed the case and I will keep it. I would hate it to be lost on the way or damage even more and I hope once i open it ,the smell is not there!!
