I'm not sure I follow what you mean? My transaction didn't take place on eBay.

I am disappointed to hear that no refund has been made and the pony is up on ebay for sale.
Have you emailed your seller inquiring about it yet?
I have, she says she didn't have the funds in her paypal balance but she's working on it. And I really don't like the sound of that..

that "tiny spot" is a pretty damn big spot, and for a collector is a pretty big flaw. It's in a prominent space, it's dark, and very noticeable. I can't see how they could possibly miss that or think that a pony with that mark could be considered mint.

Not sure if I misunderstood but did you have to pay for return postage yourself after all? Although the return is because of the sellers mistake?
She has in fact offered to refund my postage as well. But as I say, I haven't seen any money yet.

she should initiate the refund IMMEDIATELY, regardless of if she has the funds in her paypal. Paypal will pull it from another account, and if that doesn't work then they will try again in a few days, but at that point the refund is ofically on the books so she can't back out of it.

Seriously, tell her to do it now. Did you file through paypal or was this just an agreement between the two of you? Is filing with paypal still an option?

I haven't filed with PayPal as of yet, I wanted to give her an opportunity to make things right on her own, but I'm still well within my 45 days.


EDIT: Just checked paypal and $100 has been refunded.

It makes sense then why the pony is up for sale so quick.  I am going to assume the money she receives she is planning on paying you back with.

I think your doing the right thing though by giving her the chance to make it right on her own.  And as long as you are aware of your time frame to open a case then your good. Don't get me wrong I don't think it is right that she did not refund you immediately.  But as I stated above she is clearly selling the pony to raise the funds to pay you back.
 
I would just make sure she keeps communication open with you.  And keep an eye on that auction so you know when and if it sells.  It should give you an idea as to when she should be making good on her word to refund you.

I agree with everything you've said ponylady, and I think the above is what any professional seller would do.

I also agree with what Ponylady said -  keep communication and watch the auction ;)   Your seller could have done things better  (ie - refunded you the full amount right away) , but at least she is sorting things out, and she has now refunded some of the money to you :)  .  It does look like she will refund you the full amount as soon as she can.
I'm not sure why she  still insists on describing the pony as "Mint" though, when there is a noticable flaw  :huh:

Not quite, it sounds like she only got half back so far.

But I'm happy to hear you are well within the 45 day mark. Hopefully it won't take too much longer now.

Yup, I noticed that spot as well. Makes me wonder what else might be going on that the seller is not noticing :\

I also feel like the tone of her "added" information on the auction is kind of condescending. Like "For all picky collectors out there" as if it's unreasonable for a collector to want to know about flaws on a really expensive pony.

I don't know what to make of this anymore.
It's all so contradicting, the seller so reluctant to admit there is any mark at all and yet that first spot is so obvious!
And now there is a possible second mark as well?
I agree it looks like a faint mark.

Little.fox, when you had the pony at hand, did you notice any other marks than the first obvious one?

Im not too sure about that second mark, I don't remember seeing it so maybe just the camera. I still haven't heard about the rest of the money so I'm just off to send them a PM now.

Welp, she has confirmed the second spot. I feel like she is definitely trying to make sure to point these flaws out now, which is good, but only because other people have contacted her to point them out. It's a bit of a worry to me that they weren't noticed and mentioned in the first place. If we can easily spot them in a photograph, they must be noticable in person :\
