They gave me a reply... that contradicts itself. " I see that you escalated the case to us and you already sent the item back to the seller but you have not received your refund yet. I can also feel the frustration when you haven’t received the toys yet. "

Not only did they ignore all my direct questions, they only said again "once item has been delivered to the seller".... (sigh).

Now my case is "on hold" until March 3rd, and

This is rediculous. I hate canned responces, which is why its always better to speak directly to someone. I'd email them again and maybe you'll get luck and get someone who has half a brain.

I know you said you're not good on the phone, and I share you reticence to talk to strangers, especially customer service people, but it looks like they're giving you the runaround online via automated responses or someone who is clearly not paying any attention. At least you'll know if you're talking to a live person if you call. I'd suggest that if the seller doesn't contact you within 72 hours of you contacting him.

Is there someone else who can maybe speak for you on the phone and you can be there to listen and provide answers and such? I cannot emphasise enough hor horrid ebay are with online communication. To get anything done you *must* call them. If this is important to you, that's the only way to deal with it.

And yes, I was planning on having my fiance call today (and act as me. How would they know if I was a girl or boy). I was giving it 2 weeks since it had arrived. I didn't want to be too pushy. And I am very bad on the phone and can't confront. Much better through emails.... but whatever.

I translated what you wrote and got this:

I hope it will help as I am noway fluent in Spanish but it's worth a try.

Resolved!

So I finally got minutes on my phone, and extra time to place the call to ebay.

I was told that international returned goods with tracking are considered "delivered" when the item arrives in customs of the seller's country.

I don't know if I believe that is ebay's policy. I feel like if it was, then I would of been able to find that information through the hours I tried to research the topic. I also feel like, if that was true, then my case should of been closed when I initially pointed out to ebay the item was in customs, and asked "what was going to happen (if the seller didn't get it)". I do believe, though, that sitting in Argentina for 2 1/2 weeks, and the seller not picking it up, it was more of a time issue (and that I called) which is what finally granted by "buyer protection" refund.

I don't get why my seller hasn't picked up the item. I have sent him lots of messages telling him to refer to the tracking number. (sigh). I almost get the impression he doesn't understand it's there. Now with the money taken away from him, and no item, hopefully he figures it out.

Now I have to think of appropriate feedback, which of course will be negative. I do not like handing out negatives, but it's quite deserved when a transaction lasts over 2 months, and there is no communication. But I don't know what I could say that would make an impact. Nothing, I imagine.

Glad it worked out for you.

Either it's a communication thing, or he was hoping that by not picking it up it would be returned to you and thus he wouldn't have to refund.

 But I am glad it's over for you and you got your money back.  It's always frustrating when a sale goes sour.   And then to get dragged out over that amount of time is, well beyond frustrating.  I personally think the language barrier was a big thing in this case though.  He just didn't seem to get it!  But he will when he see's money gone from his account.
 
Maybe you could leave in his feedback "Pick your item up at Customs" :P

That's a great idea actually.  :D  There isn't anything negative and so Ebay can't remove it but it is very very blunt.
